AN ORDINANCE PROVIDING FOR A SPECIAL CITY ELECTION TO BE HELD IN
THE CITY OF TIGARD, OREGON, ON MAY 28, 1974, IN CONNECTION WITH
THE GENERAL STATE PRIMARY ELECTION, FOR THE PURPOSE OF SUBMITTING
TO THE LEGAL VOTERS OF THE CITY OF TIGARD, OREGON, THE QUESTION OF
ESTABLISHING A NEW TAX BASE PURSUANT TO SECTION 11, ARTICLE XI,
CONSTITUTION OF THE STATE OF OREGON,AND DECLARING AN EMERGENCY.
WHEREAS, the Council of the City of Tigard has determined
that sufficient funds to properly operate the essential functions
of the City of Tigard cannot be made available within the limits
of the presently existing tax base of the City and that there
should be submitted to the legal voters of the City the question
of establishing a new tax base in accordance with the provisions
of Section 11, Article XI, Oregon Constitution; and
WHEREAS, pursuant to Section 11, Article XI, Oregon Consti-
tutioni it is necessary to submit such question of establishing
a new tax base to the legal voters of the City at the state-wide
primary election to be held on May 28, 1974;
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The council finds that it is necessary and in the best
interests of the people of the City of Tigard that there
be submitted to the legal voters of the City at the regular state-
wide primary election to be held and conducted at all voting precincts
within the City and throughout the state on May 28, 1974, and as a
part thereof, the proposition hereinafter stated in accordance with
Section 11, Article r.I, Constitution of the State of Oregon'.
Section 2: That there should be submitted to the legal voters of
the City of Tigard voting at each precinct, or part
thereof, within the City at the said primary election of May 28,
1974, the following proposition for which purpose the following
ballot title, number and fora in which the question shall be printed
upon the official ballot is prescribed:

Explanation of the Ballot Question:
The most recent tax base proposal approved by the voters
was submitted at the primary election of 1968. Thereafter the
area of the city has increased approximately 158% and the ponu-

tax base without voter approval. Each year since 1970, the
voters have approved a levy greater than the tax base to con-
tinue essential city services. This proposal, if approved, will
enable the City to operate within the tax base and to thereby
save the expense of an annual tax levy election and provide for
continuity of essential programs and projects for an estimated
period of four (4) years in the future.

Section 3: That the foregoing proposition shall be submitted bo
the legal voters of the City of Tigard by separate
ballot at each precinct, or part thereof, in the City of Tigard
at said primary election of May 28, 19744 and the said election
with respect to said proposition shall be conducted by the regu-
lar election boards designated to conduct the regular state
primary election in said precincts on 1MaY 28, 1974. Such election
boards regularly designated to conduct saidprimary election are
hereby designated as the election boards to condlxct the election
with respect to the foregoing tax base proposal.
Section y: In all respects the conduct of the election on the
tax base proposition shall conform to the procedures
established pursuant to'law for the conduct of the primary election
in said precincts and the polls shall be opened at the same hour
and closed at the same hour and all other applicable provisions in
acco@dance with the election laws of the state of Oregon.

Section 5: Notice of the City tax base proposal in form substan-
tially as hereinafter set forth shall be given by three
weekly publications in the Tigard Times on May 9, May 16, and May
23, 1974, and by posting notice substantially in the following
form in the following designated places, scch posting to be accom-
plished not later than May 10, 1974:
(a) At the front door of the City Hall exposed to
public view, Main Street, Tigard, Oregon.
(b) In one public place in each voting precinct, or
part thereof, within the Ci4�;y
(c) At each polling place.
The City Recorder is directed to cause Lo have published and posted
said notices and shall file in the records of the City, an affidavit
of posting in usual form prior to May 15, 1974.
The form of notice shall be substantially as follows:

Notice is hereby given that pursuant to Ordinance
No. 74- 22 enacted by the City Council of Tigard on
May 6 ID-7W—, at the state of Oregon primary election of
May 26, 1974, between the hours of 8:00 o'clock A.M. and
8:00 o'clock P.M. at each precinct within the City of Tigard,
there will be submitted to the legal voters of the City of
Tigard for their approval or rejection tax base proposal as
set forth on the following fansimile sample ballot:

The foregoing proposition, if adopted will establish
a new tax base for the City of Tigard pursuant to Section
11, Article XZ, Oregon Constitution. The polling places
in the City of Tigard for the purpose of submitting the
foregoing proposition will be the same as those designated
for the state-wide primary election of May 28, 1974, and
the election will be conducted in all respects by the same
election boards as designated and appointed for the state-
wi€ts primary election.

furnished to the election boards of each precinct City ballots,
ballot boxes and 611 necessary election materials and to take any
and all other and further actions as may be required to give effect
to the provisions of this ordinances.
