Ordinance No. 73-04 CITY OF TIGARD, OREGON ORDINANCE No.73-4- AN ORDINANCE ESTABLISHING A SPECIAL REVENUE FUND DESIGNATED "FEDERAL SHARING TRUST FUND, DIRECTING DEPOSIT OF ALL FEDERAL REVENUE MTXRM NE HF."R3aTR _T0TUIRING COMPLIANCE WITH THE LOCAL BUDGET LAW WITH RESPECT TO USE OF ALL SHARING FUNDS AND PRESCRIBING °^COUNTT_NG REQUIRE- MENTS; FIXING EFFECTIVE DATE AND DECLARING AN EMERGENCY. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: There is hereby established a special revenue fund of the City of Tigard designated "FEDERAL SHARING TROT FUND" for the purpose of conforming to the requiremen s o ect on a of Public Law 92-512 of the Federal Congress known as the "Revenue Sharing Act". Section 2: All payments as and when received by the City of Tigard pursuant to the Revenue Sharing Act shall be separately maintained and deposited in said "FEDERAL SHARING TRUST FUND", to- gether with any increments thereto or interest thereon. Section 3: No obligation against or ex.�enditure from said FUND shall be undertaken at any time unless as a condition precedent thereto the requirements of §§294.305 to 294.520 ORS (Local Budget Law) have been fully met, with particular respect to budgeting and supplemental budgeting. Section 4: Obligations against or expenditures from said FUND shall conform to the limitations of Section 103(a) of the Revenue Sharing Act in pertinent part providing for priority expendi- tures as follows: "(1) ordinary and necessary maintenance and operating expenses for -- "(a) public safety (including law enforcement, fire protection and building code enforcement) "(b) environmental protection (including sewage disposal, sanitation and pollution abatement) public tranaFnrtation (including transit Systems and atreets and roads) "(d) 'health "(e) recreation "(f) libraries "(g) social services for the poor or aged, and "(h) financial administration "(2) ordinary and necessary capital expenditures authorized by law ." 7 ORDINANCE No.73- i e f Section 5: That pursuant to. Section 104 of the Revenue Sharing Act the use of moneys from said FUND either directly or indirectly to obtain federal matching funds by the City of Tigard Is expressly prohibited. Section 6: The City Recorder be, and she is hereby., authorized and �- - directed to establish all accounting records needful and necessary in accordance with prescribed procedures to account for all funds received and all obligations and expenditures thereagainst as part of the City's fiscal records, thus to currently maintain at all times proper records of accountability therefor as required by law. Section 7: Inasmuch as the City of Tigard has heretofore :received the sum of $ 22 .pp pursuant to the federal Revenue Sharing Act, d ant s necessary for the peace, health and safety of the people of the City of Tigard that immediate provision be made :to assure proper custody, accountability and use of said funds, an emergency is hereby declared to exist and this ordinance shall be. effective upon its passage by the Council and approval by the Mayor.
