Canyon Court - Portland, Oregon 97221 - Tel: 297-2237 FINAL ORDER RE: BOUNDARY CHANGE PROPOSAL NO. 510 - Annexation of the follow- ing territory to the City of Tigard Legal Description That portion of lm nd in the ,Southeast quarter of Section 3. Township 2 South, Range 1 West, Willamette !Meridian, Washington County, Oregon, being more particularly described as follows: Beginning at a point which bears South 00033' West a distance of 10.0 feet from the initial point of Viewmount, a subdivision of record in said County; said point of beginning being a point in the Northerly boundary line of old 40 foot wide County Road number 358 (S.W. Caarde Street) ; running thence North 89058'13" East a distance of 403.95 feet, along the said boundary line of County Road number 358, to an iron pipb; thence North 00037 ' East a distance of 389.66 feet to an iron pipe; thence North 89050' East a distance of 319.0 feet to an iron pipe; thence South 00037' West a distance of 389.66 feet to an iron pipe in the said boundarg line of County Road number 358; thence continuing South 00 37' West a distance of 20.0 feet to a point on the centerline of said County Road number 358; thence South 89058113" West, along the centerline of said County Road number 358, a distance of 722,95 feet to a point thereon; thence North 00033' East a distance of 20.0 feet to the point of beginning of this description. Containing 2.75 acres more or less. Proccedi ngs on Proposal. No. 510 commenced upon receipt by the Boundary Commission of a petition from property owners on November 1972 requesting that the property described above be annexed to the City. The petition meets the requirements for initiating a proposal set forth in ORS 222.170 and paragraph (a) Section '(31 of ORS 199.490. Upon receipt of the petition the Boundary Commission published and posted notice of the public hearing in accordance with ORS 199.520 and conducted public hearings on the proposal on December 13, 1972 and January 17 , 1973. The Commission also caused a study to be made on this proposal which considered economic, demographic and sociologi- cal trends and projections and physical development of the land. On the basis of the public hearing and the study the Boundary Commis- sion made a number of findings: Page 1 FINAL ORDER a) the territory to be annexed is contiguous to the City and contains 2. 75 acres and a church; b) the property owners (Tigard Assembly of God Church) request G annexation to bring the entirety of their property within the City to facilitate expansion of the church facilities under the jurisdiction of a single land use and building control agency; at present a portion of the church property is within the City and a portion outside the; City; expansion of the facilities under the current boundary situation would require the property owner to obtain land use approval C', and building code enforcement from both the City and Washing- ton County; this would necessitate the property owner paying a double set of land use and building code fees; . c) the City has sewer service available to the territory and has the capability to provide police protection and other City services to the area; and d) the boundary change will create an "island" area within the City's boundary of the Derry Dell neighborhood; the Commission is of the opinion that the roposed annexation is logical and based on meed; and any future proposed annexation of the "island" area will be subject to the same review and scrutiny as any other proposal before the Commission. On the basis of the findings listed above, the Boundary Commission approved BOUNDARY CHANGE PROPOSAL NO. 510 on January 17, 1973. NOW THEREFORE IT IS ORDERED THAT the territory described above be annexed to the City of Tigard as of this date.
