ORDINANCE No. 73
AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE
IN THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMMISSION,
ORDER No. 509 , INVOLVING LANDS OF Clarke Industries, Inc. in
Section 3, Township 2 South, Range 1 West, Willamette Meridian,
WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE, AND DECLARING
M EMERGENCY -_-
WHEREAS, the Boundary Commission established pursuant to
Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area,
by its final order dated December 13, 1972 approved the
hereinafter described change in the boundaries of the City of
Tigard, and a copy of said final order has beet filed with the
City Recorder,
NOW THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section lz That the final order of the Boundary Commission

a copy whereof is hereto attached and by this reference made a
part hereof, be, and the same is, hereby ratified, confirmed and
adopted by reference to the same legal force dnd effect as if
set forth herein in full.
Section 2i That the boundaries of the City of Tigard be, and they
are hereby, changed to include the lands as described
in the within order of the Boundary Commission, and the corporate
limits of the City of Tigard are hereby changed in conformity
therewith.
Section 3: That the Recorder of the City of Tigard be, and she
is hereby, directed to forthwith file a copy of this
ordinance, including a copy of said order, in the following
officesx
(a) Secretary of State
(b) Department of Revenue and Taxation, Washington County
(c) Department of Records and Elections, Washington County
(d) Department of Public Works, Attention. Surveyor,
Washington County
Section 4s That the City planning Commission be, and it is hereby,
authorized and directed to conduct such proceedings as
may be necessary to conform the authorized zoning and land use of
the described premises to the requirements of the City's Zoning
Map and Code,

Section 5: inasmuch as it is necessary for the peace, health and
safety of the people of the,City of Tigard that the
foregoing change in the boundaries o. the city become a permanent
part of the City's records, an emergency is hereby declared to
exist, and this ordinance shall be effective upon its passage by
the council, and approval by the Mayor.

RE: BOUNDARY CHANGE PROPOSAL NO. 509 - Annexation of the follow-
ing territory to the City of Tigard

Legal Description
Description of a tract of land located in Section 3, Township
2 South, Range 1 West, Willamette Meridian; Washington County,
Oregon and being all of lots 1, 2, 3, 4, and 5, dock 2 "Curl
Acres" a duly recorded plat and being more particularly described
as follows:
Beginning at the West one-quarter corner of said Section 3;
thence North 000 28* 00" East along the westerly line of said
*Curl Acres" a distance of 681.60 to the initial point of said
"Curl Acres" said point being 30.00 feet southerly of the center-
line of S.W. Walnut Street (when measured at right angles) ; thence
North 620 20' 2U" East along the northerly line of said "Curl
.acres" a distance of 201.02 feet to the Northwesterly corner of
block 2, said "Curl Acres" said point being the true point of
beginning of the hereinafter described tract of lands thence
North 00 28' 30' west along a northerly extension of the West
line of said block 2 of "Curl Acres" a distance of 34.02 feet
to a point int'0- c ontekline of 60 foot wide S.W. Walnut Streets
thence North 62 20' 29" East along the centerline of said S.W.
Walnut Street ('teeing parallel with the Northerly line of said
black 2) a distance of 469.03 feet to a point thereupon; thence

Proceedings on Proposal No. 509 commenced upon receipt by the
Boundary Commission of a petition from property owners on November 3 ,
1972 requesting that the property described above be annexed to the
City. The petition meets the requirements for initiating a proposal
set forth in ORS 222.170 and paragraph (a) Section (3) of ORS 199.490 .

Upon receipt of the petition the Boundary Commission published and
posted notice of the public hearing in accordance with ORS 199 . 520
and conducted a public h:;a ing on the proposal on December 13 , 1972.
The Commission also caused a. study to be made on this proposal
which considered economic, demographic and sociological trends and
projections and physical development of the land.
On the basis of the public hearing; and the study, the Boundary Com-
mission made a number of findings :
a) the territory to be annexed is contiguous to the City
and contains 2 . 12 acres of vacant property; Y
b) the property owner proposes to develop the territory
with five single family dwellings and. requests annexation
to obtain municipal services to facilitate development;
and
c) the proposed development is compatible with existing; City
and County plans for the territory and the City has an £"
sewer main adjacent to the territory which can serve the
proposed development.
