Ordinance No. 72-46 _ a 1 f E t CITY OF TIGARD, OREGON ORDINANCE No. 72 - c�L i AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE i Ila THE HOUND).AIRS Off' THE CITY OF TIGARD BY THE BOUNDARY COMMISSION, ORDER No. 446 , INVOLVING LANDS OF school District #23J in Section 3, R1W, Willamette Meridian f WASKj:NGTON cGUNTy, OREGOIZ, RECORDING EFFECTIVE DATE, AND DECLARING R2t EMERGE!iCY ` WHEREAS, the Boundary Commission established pursuant to Chapter 494 Oregon Lawn of 1959 for the Portland Metropolitan Area, by its final order dated July 12 1972 approved the hereinafter described change in the boundaries of the City of Tigard, and a copy of said final order has been filed with the City Recorder, NOW THEREFORE, t THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section is That the final order of the Boundary Commission adopted on the 12th day ofJuly, 1972 ; a copy whereof is hereto attach—eW attach—eand by this reference made a part hereof, be, and the same is, hereby ratified, confirmed and adopted by reference to the same ie0al fore -.r.d effect as s ` set forth herein in full. Section 20 That the boundaries of the City of Tigard be, and they are hereby, changed to include the lands as described in the within order of the Boundary Commission, and the corporate limits of the City of Tigard are hereby changed in conformity therewith. y Section 3e That the Recorder of the City of Tigard be, and she is hereby, directed to forthwith file a copy of this ordinance, including a copy of said order, in the following offices: n (a) Secretary of State (b) Department of Revenue and Taxation, Washington County (c) Department of Records and Elections, Washington County (d) Department of Public Works, Attentions Surveyor, Washington County Section 4_s That the City Planning Commission be, and it is hereby, authorized and directed to conduct such proceedings as € may be necessary to conform the authorized zoning and land use of the d83cribed premises to the requirements of the City's Zoning plop and Code. Tiedeman Avenue) with the centerline of 40.foot wide County Road No. 494 (S.W. Walnut Street); running thence Northerly, along the centerline of said County Road No. 495 (S.W. Proceedings on Proposal No. 446 commenced upon receipt by the Boundary Commission of a-petition from property owners on June 15, 1972 requesting that the property described above be annexed to the City. The petition meets the requirements for initiating'a proposal set £orth.in' ORB 222.170 and paragraph (a) Section (3) of ORS 199.490 t F Page 1 FINAL ORDER Upon receipt of tha petition the Boundary Commission published 1 aid posted notice of the public hearing in accordance with ORS j 199.$20 and conducted a public hearing on the proposal on July 12, {l 1972. The Commission also caused a study to be made on this pro- posal which considered economic, demographic and sociological trends and projections and physical development of tho land. � On the basis of the public hearing and the study, the Boundary Commission made a number of findings: a) the territory to be aainexed is contiguous to the City and contains 27.66 acres, 2 single family dwellingF and an estimated population of 7 persons; t b) most of the property is owned by the school district which requests annexation to facilitate the construction k of a new junior high school; [¢ c) police and collector sewer services are immediately avail able from the city; and d) the proposed development of the site is in accordance with the city's comprehensive land use plan. On the basis of the findings listed above, the Boundary Commission approved BOUNDARY CHANGE PROPOSAL NO. 446 on July 12, 1972. NOW THEREFORE IT IS ORDERED THAT the territory described above be annexed to the City of Tigard as of this date.
