Ordinance No. 72-40 CITY OP TIGARD, OREGON s ORDINANCE No. I'N ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO TIIE LANDS OF t Elizab- th Hambbach in Section 12, Township 2 South, Range 1 West, Willamette Meridian. TIGARD, WASHINGTON COUNTY. OREGON. WHEREAS. the hereinafter described lands, by action of the � City Council of the City of Tigard, Oregon, pursuant to the Zoning R Code of said City, have heretofore been limited in the use to those uses permitted by said Code, under, and have been classified and zoned for,R-7, Single Family Residential, and WHEREAS, pursuant to prescribed procedures, the owner of said lands has applied to the City of Tigard for reclaadification of said property and change of zone thereof to permit the use thereof for P-D, Planned Development purposes, and said application has E 'been duly publicized and public hearing held by the City Planning � Commission on May 16, 1972 after due and legal notice; and P WHEREAS, the Planning Commission has recommended approval of said zone change to the City Council, and due and legal notice of City Council hearing having been given by publication in the Tigard Times, and the City Council having heard same at its regular meeting of June 12, 1972, and the Council finding that no public detriment will result from granting of said petition, and that it is in tho public interest that said zone change be approved, and the fends re-zoned from R-7, Single Family Residential to R P-D, Planned ^+envelopment. I NOW, THEREFORE, , THE CITY OF TIGARD ORDAINS AS FOLLOWS- Section 1: OLLOWS:Sectionn1: That the following described lands be, and the same are hereby zoned as P-D for use in accordance with the P-D, Planned Development classification of the zoning- code of the City of Tigard, subject to the conditions set forth on the attached sheet entitled "CONDITIONS", which by reference is made a part hereof and to which all conditions and requirements the development of said lands shall be and remain subject. Beginning at a paint in the West line of Lot 7, Wilson Acres, a subdivision of record in Washington County, Oregon, 70.72 feet North from the Northwest corner o` Lot 8: running thence Northerly on the East line of said Wilson Acres 562.7 feet to a point; thence Easterly to a point in the East line of Wilson Acres, which point is 633.43 feet North from the Northeast corner of Lot 8; thence South along the East line of Wilson Acres 562.7 feet to a points thence Westerly to the place of beginning. EXCEPTING, herefrom that portion of land dsdicikbed to the public for roadway purposes (60 foot wide, S.W. Hall Blvd.) Section 2: This ordinance shall be effective on the 31st day after its enactment by the City Council of Tigard, Oregon. ARCS No. ,72- 4n k EXHIBIT "A" CONDITIONS 1. The total number of dwelling units shall be no more than 36, including no more than 5 duplexes to be located only on lots abutting Hall Blvd. 2. That the normal front, side and rear setbacks may be waived, except the rear setbacks along the perimeter lot lines of the eclat shall be a minimum of 15 feet, and provided that each dwelling unit shall have at least one yard of 20 feet or more, and that plans be approved by the Planning Department. 3. That all utilities shall be underground. 4. That landscaping plans showing the sues, locations and types: of trees and plant materials for the common area cul-de-sac islands, and the Hall Blvd. frontage be approved by the Planning Department, That an earth berm be constructed along the frontage of Hall Blvd, having a minimum height of 3 feet, to be located at least 10 feet from the existing right-of-way of :Tall. Blvd. 6. That duplexes and single family dwellings may have common walls, plans to be approved by the Planning Department. 7. That a Homeowners Association agreement, approved by the City Attorney, be executed to insure maintenance of common area and landscaping. 8. That 10 feet be dedicated to the City along the frontage of Hall Blvd. for future street improvements, and that individual lots shall not have direct access to Hall Blvd. 9. That engineering plans and specifications shall be approved prior to acceptance of the Final Plat. 10. That the preliminary plat shall be identified as such, dated and have a north point, 11. That the scale of the preliminary plat shall be revised to show surrounding subdivision and/or 'Lot patterns. 12.
