Ordinance No. 72-38 CITY OF TIGARD, OREGON ORDINANCE No. 72--,3,1 AN ORDINANCE ADOPTING THE BUDGET FOR THE YEAR 1972-1973, PRO- VIDING FOR A SPECIAL ELECTION TO BE HELD IN THE CITY OF .TIGARD ON JUNE 6, 1972,FDR THE PURPOSE OF SUBMITTING TO THE LEGAL VOTERS OF THE CI'T'Y 'VdE QUESTION OF LEVYING TAXES FOR THE YEAR BEGINNING JULY 1, �.. 1972, AND ENDING JUNE 3U, 1973, FOR MAINTENANCE AND OPERATION OF THE CITY 1N TLiE SUM OF $118,943.00 IN EXCESS OF THE TAX BASE, AND DECLAR- ING AN EMERGENCY. WHEREAS, the budget for the City of Tigard for the year begin- ning July 1, 1972, and ending June 30, 1973, was duly approved by the Budget Committee at its meeting of May let , 1972, after proceedings In accordance with Chapter 294 ORS; and UREREAS, a hearing by the City Coui_cil on the budget_._ ns, apDrVved by the Budget Committee, after due and legal notice was held on the 22nd day of May, 1972, whereat all interested persons were afforded an opportunity to appear and be heard for and against any item in the budget; and WHEREAS, the Council has determined that sufficient funds to operate the essential functions of the City of Tigard for the period Jul:' 1, 1972, to June 30, 1973, cannot be made available within the limits of the presently existing tax base of the City, and therefore, 't is necessary to submit the following proposition to the voters of the City at a special election called and held for that purpose; and WHEREAS, of the total proposed general fund tax levy for said period, $117,796.00 is within the limitation of Section 11, Article XI, Oregon Constitution, and the sum of $118,943.00 is in excess of said limitation, it is necessary to submit to the legal voters the question hereinafter set forth;, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section l: That the budget for the year beginning July 1, 1972, and ending June 30, 1973, as heretofore adopted by the Budget Committee and as duly published and heard, a copy whereof being here- to attached and by reference made a part hereof, be, and the same is, ! hereby adopted. Section 2: That a special election is hereby called to be held on Tuesday, June o, 1972, between the hours of 8:00 a.m. and 8:00 p.m., at the designated polling place, Fowler Junior High School, 12080 S,W. Main Street, Tigard, Oregon, for the purpose of submitting to the legal voters of the City the following proposition, for which purpose the following ballot title, number and 'form in which the question shall be printed upon the official ballot is pre- scribed: Submitted to the voters by the City Council: "Shall the City of Tigard be authorized to levy for- ^ maintenance and operation of the City for the period beginning July 1, 1972, and ending June 30, 1973, the 100. sum of $116,943.00 in excess of the tax base of the City, computed in accordance with Section ll, Article XI, Oregon VOnSsl.lt Ut ionill;a:'?" Page i ORDINANCE No. 72- 38 Exxlanation of the Ballot question: This is not a new tax; it replaces the levy voters approved last year. The purpose of the levy is to provide funds for con- tinuation of police protection, planning, library service, park maintenance and other city services, If this measure is approved, the operating budget to be financed by local taxes for the tax year. 1972-1973 will be $12829.00 greater than the operating budget finances by local taxes for the precedinS year. Although the operating budget will be greater, the total tax levy for the City will be less for the 1972•-1973 year than the preceding year, the difference being represented by higher non-tax revenues forecasted to be received by the City during the year 1972-1973.
