Ordinance No. 72-32 CITY OF TIGARD, OREGON ORDINANCE No. 72--32 AN ORDINANCE AMENDING SECTIONS 205, 301 AND 404 OF ORDINANCE No. 71-5 - SIGN ORDINANCE•' OF' THE CITY OF TIGARD - PRESCRIBING FS'FFECTIVE DA'PEAND DEC_T,RINS A:J 1S1L12GENCY. _ �_ _� THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: The City Council finds that pursuant to Ordinance No. 71-5 the City of Tigard "SIGN ORDI-ANCI?", the herein- after amen_iments to said sign ordinance, after due and legal notice, were submitted to public hearing by the City Planning Coimission on March 21, 1972, and the Council thereafter recommended that said sign ordinance be amended as hereinafter set forth. Section 2: The Council further finds that after due and legal notice a public hearing was held by the City Council on April 10, 1972 whereat all interested persons were afforded an opportunity to be heard with respect thereto, and the Council further finds that all legal and proper actions have been taken and conditions precedent fulfilled with respect to the amendments to the City's Sign Ordinance as hereinafter set forth. Section 3: That Section 205 (4) - Nonconforming Signs - of Ordinance No. 71-5, be, and the same is, hereby amended to read as follows: "Section 205 Nonconforming Signs: 11(4) Signs in existence on the effective date of this ordinance which do not comply with provisions regulating flashing signs; use of par spot lights or rotating beacons; rotating and revolving signs; flags, banners, streamers or strings of lights, (or temporary or incidental signs) shall be made to conform within ninety (90) days from the effective date of this ordinance." Section 4a That Section 30l (4) - Directional Signs - of. Ordinance No. 71-5, be, and the same is, hereby amended to read as follows: "Section 301 - Directional Si ns: (4) Directional signs may be located at street inter- sections within all zones, after approval by the City of Tigard Planning Commission. Such signs shell be 12" x 42", pointed at one end, any painted colors, lettering or design symbols. Not more than 8 such signs shall be permitted at any one street intersection. The sign shall be provided by the developer and turned over to the city public Works Department with a fee of $10.00 per sign. The city will erect the sign at heights Eand location approved by the Planning Commission. Directional Signs may be allowed for the following i� uses and others held similar by the Planning Commission: oPDINANCE No. 72--32 4,Vi a) Public elementary, junior and high schools b) Public parks and golf courses c) 'ojjununity shopping centers d) Regional supping centers e) industrial parks stadiums f) public auditoriums, coliseums, civic centers or meeting places �. ' Section S: That Section 404 (7) - Certain signs prohibited of ordinance No. 71-5, be, and the same is, hereby azended to read as follows: ) "Section 404: Certain Signs Prohibited: (7) All signs Of an incidental or temporary nature not permanently affixed to the ground, with the exception of real estate signs as permitted in section 301, 302 and 303." Section 6; inasmuch as it is necessary for the peace, health and safety of the people of the City of 'Tigard that the integrity and continuity of the ordinances regulating signs and matters relating thereto in the City•of Tigard by currently updated, an emergency is hereby declared to exist and this ordinance shall be effective upon its enactment by the Council and approval by the Mayor.
