Ordinance No. 72-30 CITY OF TIL, OREGON ORDINAIICS No.72-:�'O f AN ORDINANCE ESTABLISHING A PUBLIC LIBRARY; PROVIDING FOR THE APPOINTMENT OF A LIBRARY BOARD; PRESCRIBING FEES FOR THE USE THE*REOF; ,EK,ALING ORDINANCE No.63-16, AND PiRESCRISINu_EFFECTIVn" DATE. 1 i - THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: 'Title. t Thicordinance shall be known and may be cited as: "The } City of Tiard Library Ordinance." Section 2: Public Library Established. A public library is hereby established in and for the City of Tigard, Oregon. Section 3. Library Board. There 3s hereby established a Library Board of five (3) members. The present members of the Library Board appointed pursuant to Ordinance No. 63-16 shall continue in office for the balance of their terms. Term: The term of office of Library Board members shall begin January 1, and the term of office shall be four (1I) years, or until a successor is :appointed. Appointment: Candidates for appointment to the Lib2-3r, Bo=ard shall be proposed by recor:uaendation of the current Library Board membership, Not to exceed two (2) members of the Board may reside outside tiie corporate limiter of theCity. Board members shall receive no compensation. At the expiration of the term of any member of the n Library Board, the Mayor, subject to confirmation by the City Council, shall appoint a new member for a_ term of four years. If a vacancy occurs for any reason other than expiration of term, the mayor, sub- ject to confirmation by the Council, shall appoint a new member to serve for the unexpired term. Officers: The Library Board shall., at its first meeting after the effective date of this ordinance, elect a president and vice- president, who shall hold office during the pleasure of the Board, and the Board shall elect a secretary who need riot be a member of the Board, and the secretary shall keep accurate records of all Beard meetings. Section 4: Duties and Power. The City Library Board shall have the duty and power to advise the City Administrator and the City Council with respect to the management, control and operation of the library facilities within the City and shall recommend such rules and reguiaf,ions as necessary for the maintenance of order, safety and utilization of such facili- ties, and make recommendations concerning expenditure of 3. -.,h funds as shall be appropriated by the City COunCil for public library pur poses and programs. "Library Ordinance" 1 Section 5: Donated Funds, a7.1 funds donated to the City for library purposes shall be sabject to the same rules, regulations and expenditure control as applicable to appropriated funds; provided, however, that such donated funds shall be accounted for under the caption of "Public Library Donations", and such funds shall be subject to expenditure only for the purposes for which donated, except that funds received from donors without specific limitations as to use, may be used for general library purposes. Section 6: Fees. ` �In order to partially defray the cost of maintenance and operation of the library facilities by the City, the Council shall by resolution from time to time fix a reasonable fee to be collected by the Librarian from all persons non-resident in the City who apply far library privileges. The charge to be in effect at the time of adoption of this ordinance is the sum of $2.00 _ per ,year for non-residents. Residents of the City shall not be :required to pay a library fee but shall be liable to pay such fines or late charges as z` may be prescribed by resolution of the Council. All fees and charges received for library services shall be accounted for as general fund receipts under the heading of "Public Library". Section7: Rep aler. -` Urdinanee No. 63-16 adopted by the City Council on the 28th day of October, 1963, be, and the same is, hereby repealed effective with the effective date of this ordinance.
