Ordinance No. 72-18 CITY OF TIGARD, OREGON ORDINANCE No.72-_Lj_ AN ORDINANCE AMENDING Section 10-(b) of Ordinance No. 62-9 - GRANTING TO WEST COAST TELEP�IONE COi�tPANY A FRANCHISE FO1?_ mHE OPERATION OF A 00164UNI CATION SYSTEM WITHIN THE CITY OF TIGARD, BY PROVIDING FOR AN INCREASE FROM 2-1J2% to 3% OF GROSS REVENUES DERIVED FROM THE OPERATION OF A GENERAL TELEPHONE BUSINESS EFFECTIVE APRIL 1, 1972, AND DECLARING AN EMERGENCY.THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That in recognition of the fact that GENERAL TELEPHONE COMPANY OF THE NORTHWEST is successor utility to the named franchise holder, to-wit: West Coast Telephone Company, with respect to Ordinance No. 62-9, all references in said ordinance to West Coast Telephone Company shall be deemed to refer to GENERAL TEL EPHONE COMPANY OF THE NORTHWEST. Section 2: That Section 10(b) of Ordinance No. 62-9 adopted by the City Council on Mar.:h 19,1962, granting to West Coast Telephone Company certain rights and privileges, be, and the same is, hereby amended to read as follows: "(b) As compensation for the rights and pri7ileges herein granted, in addition to any other consideration in this ordinance expressed, the Company shall pay to the City an amount equal to three per cent (3p) of the gross' revenue each year derived by the Company from local ex- change service rendered subscribers within the corporate limits of the City of Tigard, such revenue to be deter- mined in accordance with lawful rate and rate groupings applicable to the exchange, exclusive of extended area service; such amounts to accrue beginning April 1, 1972," Section 3: That the acceptance of this amendment to Ordinance #62-9 and the agreement of General Telephone Company of the Northwest to be botiind hereby is hereto attached and by this reference made a part hereof to the same force and effect as if set forth. herein in full. Section 44: Inasmuch as it is necessary for the peace, health and safety of the people of the City of Tigard that the sources and rates of revenue from public utilities within the City be ' maintained on a current basig, an emergency is hereby. declared to exist, and this ordinance shall be effective upon its passage by the Council and approval of the Mayor.
