AN ORDINANCE APPROVING AN APPLICATION TO DESIGNATE A TRACT OF
Awl LAND DESCRIBED AS Lot 9, KNOLL ACRES, IN THE CITY OF TIGARD, AS OPEN
SPACE LAND PURSUANT TO §§308.750 et seq ORS.; FIXING EFFECTIVE DATE
AND DECLARING AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS :FOLLOWS:
Section 1: The City Council finds that heretofore there was filed
with the Department of Revenue and Taxation, Washington
County, Oregon, pursuant to §308.750 ORS, an application for open
space use assessment with respect to Lot 9,Knoll Acres, and that on
December 28, 1971 said application was referred by the Department of
Revenue and Taxation to the City of Tigard for action under authority
of 5§308.750 et seq ORS.
Section 2: The Council further finds that a hearing was duly and
regularly called and held by the City Planning Commission
on February 15, 1972 and that thereafter the Planning Commission
recommended to the Council the granting of said application.
Section 3: The Council finds that a hearing before the City Council
was duly held on tat,, -r,�3 1972 pursuant to
notice published in the Tigard Times on Parch 9, 1972 and that notice
was given in the same manner in which an amendment to the Compre-
hensive Plan of the City is processed, and that all interested persons
and the general public were afforded an opportunity to be heard with
respect to said application; and the Council thereafter weighed the
benefits to the general welfare of preserving the current use of the
property described in the application against the potential loss in
revenuewhich may result from granting the application.
Section 4: The Council finds and determines that preservation of
the current use of the land for open space purposes will
and does meet the criteria aet forth in §308.755(2) subsections (a)
to (h) inclusive, and said factors greatly outweigh the potential
loss of revenue that may result frorj granting the application.
Section 5: Consistent with the foregoing, the City Council does
hereby approve the application of Knoll Drive Corporation,
12490 S. W. Knoll Drive, Tigard, Oregon with respect to Lot 9, Knoll
Acres, Tigard, Washington County, Oregon and the whole of the area
thereof for open space purposes
Section 6: The Council further finds that the open space txe upon
which this approval is based, is to enhance the value
to the public of open spaces, enhance recreational opportunities and
provide, losal playground area.
Section 7: The Ci�y Recorder be, and she is hereby, directed to
notify the Department of Revenue and Taxation, Washington
_ County, Oregon -(County Assessor), and Knoll Drive Corporation, c/o
Ivan Jack, President, 3.2490 S. W. Knoll Drive, Tigard, Oregon, of

the approval of the application, not later than April 1, 1972, by
directing to each of them a copy of this Ordinance, am the Recorder
be, and she is hereby, further ordered and directed to file a copy
of this Ordinance in the permanent zoning records of theCity of
Tigard.
Section 8: Inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard that the
matters set forth in this Ordinance be determined and become effect-
ive with the least possible delay, in order to assure the continued
use of the premises for playground purposes, an emergency is hereby
declared to exist, and this Ordinance shall become effective upon its
passage by the Council and approval by the Mayor.
PASSED: By unanimous vote of all Council members present, after
being read three times by number and title only,
this 13th day of March, 1972.
