Chaput in Section 34, Township South, WASHINGTON COUNTY, OREGON, RECORDING gWillamette EFFECTIVE DATE, AND DECLARING AN EMERGE- WHEREriS, the Boundary Cor nission established pursuant to Chapter 494 Oregon Laws of 1964 for the Portland Metropolitan Area, by its final order dated a 9 approved he hereinafter described change n e spun ar es of the city of Tigard, and a copy of said final order has been filed with the city Recorder, NOW THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the final order of the Boundary Commission adopted on the 1�Lhh _ day of January_ 19,72 ___ a copy whereof ishereto attached and by th s reference made a part hereof, be, and the same is, hereby ratified, confirmed and adopted by reference to the same legal force and effect as if set forth herein in full. Section 2: . That the boundaries of the City of Ti.gaxd be, and they are 'hereby, changed to include the lands as described in the within order of the Boundary cosm.ission, and the corporate limits of the city of Tigard are hereby charged in conformity therewith. Section 3: That the Recorder of the city of Tigard be, and she is harebv. directed to forthwith file a copy of this ordinance, including a copy of said order, in the following otficas: (a) Secretary of State (b) Department of Revenue and Taxation, Washington County (c) Department of Records and Elections, Washington County (d, Department of Public Works, Attention: Surveyor, Washington County Section 4: That the City Planning commission be, and it is hereby, authorized and directed to conduct such proceedings as may be necessary to conform the authorized zoning and land use of the described premisee to the requirement® of the City°e Zoning Map;and code, Section 5„e inasmuch as it is necessary for the peace, health and safety of vhe people of the city of Tigard that the foregoing change in the boundaries of the City become,a permanent part of the city's records, an emergency is hersoy declared. to / exist, and this ordinance shall be effective upon its passage by the 'council, and approval:by the Mayor. Canyon Court - Portland, Oregon 97221 - Tel: 297-2237 FINAL ORDER RE: BOUNDARY CHANGE PROPOSAL NO. 354 - Annexation of the :following territory to the City of Tigard Legal Description That portion of land in the Southeast quarter of Section 34, Township 1 South, Lange 1 West, Willamette Meridian, Washington County, Oregon, being more particularly described as follows: Beginning at the Northwest corner of that tract of land conveyed to Burt E. Conkle, BotYK 821, Page 617, Deed Records of said County; running thence South, along the West boundary line of the Can}:le tract, a distance of 165 feet to the Southwestcorner thereof; thance East, along the South boundary line of the Conkle tract, a distance of 280 feet to the Southeast corner thereof; said Southeast corner bring a print in the center of 40 foot wide County Road No. A55 (S.W. Tiedeman Avenue) ; thence continuing East, along an Easterly extension of the South boundary line of the Conkle tract, to a point of intersection' with the West boundary line of Lot 12 of Creenburg Heights Addition, a subdivision of record in said County; thence Northerly and Northeasterly, along the West boundary line of Lot 12 of said sbdivi,sion, to a point of intersection with an Easterly extension of the North boundary line of the Conkle tract; thence West, along the said E'aster'ly extension of the worth boundary line of the Co.nk.le tract, to the Northeast cornea thereof; said Northeast corner of the Conkle tract bring a point in the center of said County road No. A55; thence West, along the North boundaey line of the Conkle tract, a distance of 375 feet to the point of beginning of this description. Containing, approximately, 1.19 acres. Proceedings on Proposal No. 354 commenced upon receipt by the Boundary Commission of a resolution from the City Council on November 4, 1971 requesting that the property described above be annexed to the City. The resolution meets the requirements for initiating a proposal set forth in ORS 199.490, particularly Section 2 and -paragraph (a) of Section (1) . Upon receipt of the resolution, the Boundary Commission published and posted notice of the public ?Yearing in accordance with ORS 199.520 and conducted a public hearing on the proposal on December 1, 1971. Page 14 FINAL ORDER The Commission also caused a study to be made on this proposal which considered economic, demographic and sociological trends and projections and physical development of the land. On the basis of the public, hearing and the study, the Boundary Commission made a number of findings : a) the territory to be annexed is contiguous to the City; b) the territory contains 1 acre, 1 single family dwelling and an estimated population of 3 persons; c) the City proposed this boundary change as part of a total program to annex its fringe area because the City's irregular boundaries are hampering the orderly and efficient administration of certain public services in the area--specifically police protection, local street construction and maintenance and land use planning and control; _ d) the City has recently completed a comprehensive land use planning program and the Cbuncil has adopted the "Tigard Community Plan." which includes the property in this boundary change proposal; e) . the territory is within the service sphere of the City for sanitary sewerage service and police protection. y On the basis of the findings listed above, the Boundary Commission approved BOUNDARY CHANGE PROPOSAL NO. 354 on January 19, 1972. NOW THEREFORE IT IS ORDERED THAT the territory described above be annexed to the City of Tigard as of 45 days from this date or at what other subsequent date that the law rewires.
