Ordinance No. 72-07 4 CITY OF TIGARD, OREGON ORDINANCE No. f AN ORDINANCE RATIFYING, CONFI-RM:NG TUND RECORDING CHANGE IN TAE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY,COMMISSION, ORDER NO. 353 , INVOLVING LANDS OF Southern Pacific Transportation Company, A.-T& Doris E. Nelson, & Kenneth D. & Edna M. Pressna,ll, in Section 12, Township 2 South, Range 1 West, Willamette Meridian, WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE, AND DECLARING AN EMERGENCY. WHEREAS, The Boundary -Commission established pursuant to Chapter 494 Oregon Laws Of ;969 for the Portland Metropolitan Area, by its final order dated Jaw 1 19 .1.972 approved the hereinafter described change in the boundaries of the City of Tigard, and a copy of said final order has been filed with the City Recorder, NOW THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the final order of the Boundary Commission adopted on the 19th_ day of Januacv, 1972 a copy whereof is hereto attached and. by this reference made a part hereof, be, and the same is, hereby ratified, confirmed and adopted by reference to the same legal force and Effect as if set forth herein in full. Section 2• That the boundaries of the City of Tigard be, and they are hereby, chanaed to include the lands as described in the within order of the Boundary Counn.ission, and the corporate limits of the City of Tigard are hereby changed in conformity therewith. Section 3: That the Recorder of tha City of Tigard be, and she is hereby, directed to forthwith File a copy of this ordinance, including a ropy of said Order, in the following offices: (a) Secretary of State _d Taxation, Washington County (b) Department or Revenue an (c) Department of Records and Elections, Washington County (d) Department of Public Works, Attention: Surveyor, Washington County Section 4: That the City planning Commission be, and it is hereby, authorized and directed to conduct such proceedings as may be necessary to conform the authorized zoning and land use of the described premises to the requirements of the Cii:y's Zoning Map and Code. Section 5: Inasmuch as it is necessary for the peace,-health and safety of the people of the City of Tigard that the foregoing change in the boundaries of the City become a per-manent 9 part of the City's records, an emergency is hereby declared to exist, and this ordinance shall be effective upon its passage by the council, and approval by the Mayor. R lenge 1 West, Willamette Meridian, Washington County, Oregon, being more particularly described as follows: Beginning at the Northeast corner of said Section 12; thence South, along the East boundary line of Section 12, a distance of 659.9 feet to a point of intersection with the South line of the North half of the Northeast quarter of the Northeast quarter of Section 121 said point of intersection being the True Point of Beginning of this description; running thence South 890 49' West, along the said South line, a distance of 776.7 feet to the Northwest corner of that tract of land conveyed to A. T. & Doris E. Nelson, Boo?. 671., Page 281, Deed Records of said County; thence South 000 09' West, along the West boundary line and along a Southerly extension thereof of the nelson tract of land, a distance of 666.53 feet to a paint on the Northerly boundary line; of Lot 4 of Bonita Gardens, a subdivision of record in said County; said point being Easterly of the Northwest corner of Lot 4 a distance of 10.4 feet; . thence East, along the North boundary line of Lot 4, a distance of 81.6 feet to a point; thence South, parallel with and 92.0 feet Easterly of the West boundary Line of Lot 4, a distance of 4736.0 feet to a point on the South boundary line of Lot 4; thence East, along the South boundary line of Lot 4 and along the South boundary line of Lot 3 of Bonita Gardens, a distance of 628.9 feet to a point on the Westerly right-of-way boundary line of State Primary Highway No. 1 (R. Baldoc% rreeway, Interstate No. 5) thence continuing East., along the Som"I boundary line of Lot 3, a distance of 71. 1 feet to the Southeast corner of Lot 3; said Southeast corner of Lot 3 being a point on the East boundary line of said Section 12; thence North, along the East boundary line of Section 12, a distance of 1139.5 feet, more or less, to a -Trace Point of Beginning of this description. - Proceedings on Proposal No 353 commenced upon receipt by the Boundary Commission of a resolution from the City Council on November 4, 1971 requesting that; the property described above be annexed to the City. The resolution meets the requirements for initiating a proposal set forth in ORS 199.490, particularly Section 2 and paragraph (a) of Section Cl) - Page 1 FINAL ORDER F Upon receipt of the resolution, the Boundary Commission published and posted notice of the public hearing in accordance with ORS 199.520 and conducted a public hearing on the proposal on December 1, 1971. The Commission also caused a study to be made on this proposal which considered economic, demographic and sociolo- gical trends and projections and physical development of the land. On the basis of the public hearing and tha study, the Boundary Commission made a number of findings: a) the territory to be annexed is contiguous to the City; b) the territory contains 14 acres and is undeveloped industrial property; C) the City proposed this boundary change as part of a total program to annex its fringe area because the City's irregular boundaries are hampering the orderly and efficient administration of certain public services in the area--specifically police protection, local street construction and maintenance and land use planning and control; d) the City has recently completed a comprehensive land use planning program and the Council has adopted the "Tigard Community Plan" which includes the property in this boundary change proposal; e) the territory is within the service sphere of the City for police protection. On. the basis of the findings listed above, the Boundary Commission approved BOUNDARY CHANGE PROPOSAL NO. 353 on January 19, 1972. NOW THEREFORE IT IS ORDERED THAT the territory described above be annexed to the City of Tigard as of 45 days from this date or at what other subsequent date that the law requires.
