Ordinance No. 72-02 CITY OF TIGARD, OREGON ORmAxca No. 72 - AN ORDINANCE AUTHORIZ76MG CONDITIONAL t3SE(S) ON :FENDS OF Edwin W. and Patricia DeKoning in Section 1, Township 2 South, P.ange 1 „ West, Willamette Meridian TIGARD-WASHINGTON CtLU_MYe OREGON WHEREAS, the owner(s) of the lands described on attached Exhibit "A" by reference made a part hereof. has (have) filed with the City an application for authorization to conduct the following described conditional use(s) on the said premiseei and WHEREAS, the zoning classification of said lands hereto- fore estab'•iahed by the zoning ordinances of the City of Tigard is 0.1-3, Light Industrial and the conditional use(s) requested by the applicant(s) may be properly permitted in con- formity with the said classification; and WHEREAS, the City Planning Commission on the 21st day of December 19 71, held a public hearing with respect to said application andsaidCommission has recommended to the City Council that said application be approved; and WHEREAS, a public hearing before the city Council with respect to said application was duly and regularly held on the 10th___ day of January , 1971, and the City Council finds that no,public detriment �a�ill ree�ult from the gxanting of said petition and that it Ws in the plsblic interest that said condi- tional use(s) be authorized, NOW, THERWORE, THE CITY OF TIGARD OPT1kINS AS FOLLOWS: Section la. That the fol.lowing .conditional use(s) as defined in the City of Tigard Zoning ordinance under the zone classification M--3, Light industrial to-wit.. To allow outside storage & temporary offices. be and the same are hereby authorized with respect to the lands described on Exhibit "All ky reference made a part hereof, subject to compliance with the following conditions: 1. 'The use of.the three temporary offices shall be limited to a period of one year, at the end of which time permanent or alternative office space shall be utilized. 2. The outside storage area shall be located behind the building and enclosed by a sight-obscuring fence, plans to be approved by the City staff. If the existing lumber sorter and stacker is no longer in use it shall be dismantled and removed. otherwise, it shall be maintained in good condition. { ,r ?1 ORDINANCE No. 72- ti 3. A dense strip of trees shall be planted along the westerly property line if an agreement for an easement or purchase is accepted by the adjoining property owners, in addition, the front 10 feet of '-!Le subject property shall be landscaped and maintained. Xf an arxrkemetit cannot be reached with the adjoining proverty owners, a sight- obscuring fsnce 6 to 8 feet in hei.gn- ;hall be constructed along the westerly prcperty line. Said fence shall run from the existing maneuvering area, along the top of the retaining wall., to an area where an evergreen screen can be planted on the si±sject property, h. A detailed parking, fencing and landscaping pla:i shooing the location, varieties and sizes c.,f trees and plant materials, and st ipad parking spaces, shall be approved by the City staff. 5. Paving, striping. fencing and landscaping shall be implemented by May 1, 1972. 6. That the oiltside storage area be maintained in a neat and orderlv manner. 7. windows shall b<: scieened from adjoining residential uses to eliminate visual nuisances resulting from arc: welding or othez industrial processes. Section 2: The City Recorder is hereby authorized and directed to certify a true copy of this Ordinance and forward same to the applicant forthwith. r Section 3: This Ordinance shall be effective on and after the 31st day from its enactment by the City Cou:eil of the City of Tigard, Oregon.
