LEGISLATIVE, SESSION, AND DECLARING AN EMERGENCY
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That by virtue of authority contained in §221.330 Oregon
Revised Statutes, all those certain sections of Chapters
483, 4814 and. 485, ORS hereinafter in this ordinance listed by section
number and sub-section number with suffix (T) and titles, and being
section numbers identical to those of applicable sections of Oregon
Revised Statutes as amended. supplemented or originally enacted by
the Oregon Legislative Session of 1971, be, and each and all thereof
are hereby adopted by this reference section by section, paragraph by
paragraph, word by ward in the entirety in all respects to the same
legal force and effect as if set forth herein in full.
Section 2: Each section or sub-section of Oregon Revised Statutes
hereinafter numbered and titled, when cited by the sec-
tion number as identified in this ordinance together with suffix (T),
shall be referenced as a section or sub--section of the "Motor Vehicle
Code of the City of Tigard", and may be cited as such.
Section 3: Chapter- IV (Chapter 463, ORS) - Motor Vehicle Traffic and

Section 483.020 (T) is hereby amended to conform to

Tigard" be and the same is hereby amended as follows:
Section 485.010 (T) is hereby amended to conform to
OHS 485.010 as amended by Section 5, Chapter 607,
O.L. of 1971.
Section 1=85,020 (T) is hereby amended to conform to
CRS 485.020 as amended by Section 6, Chapter 607, O.L.

Section 6: Chapter IV (Chapter 483, ORS) - Motor Vehicle Traffic
and Equipment �- of Ordinance 70-41 "Motor Vehicle Code
of the City of Tigard" be, and the same is hereby amended to add the
following new section which by Section 2, Chapter 340, Oregon Laws
of 1971 was added to and made a part of ORS 483.114 to 483.118:
Section i1) The driver of any vehicle
shall exercise reasonaFle control of the vehicle which
f, he is driving as may be necessary to avoid colliding with
any object. A collision is not necessary in order to be
in violationof this section,
(2) Subsection (1) of this section does not_change
the rules of pleading and evidence relating to negligence
and contributory negligence.
This section shall be designated in the Tigard Motor Vehicle
Code by the Oregon Revised Statute section nwnber that has been
or;will be assigned to Section 3, Chanter 340, Oregon Laws of
1971, by the codification authority followed by the suffix "(T)".
Section 7: Inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard that the
provisions of the Motor Vehicle Code of the City of Tigard conform
to the provisions of Oregon Laws of 1971, ,immediately, an emergency
is hereby declared to exist and this ordinance shall become ef-
fective upon its passage by the Council and approval by the Mayor,
PASSED:by unanimous vote of all Council members present,
after being read three times by number and title only, this 13th
day of December, 1971. � ,
