Ordinance No. 71-35 CITY OF TIGARD, OREGON ORDINANCE NO. AN ORDINANCE AMENDING Section 270-8, FEES, of Ordinance No. 70-32, (City of Tigard Zoning Ordinance of 1970), as amended by Ordinance No. 71-4, TO PRESCRIBE FEES FOR PLANNED DEVELOPMENT l DISTRICT ZONING APPLICATIONS, DECLARING AN EMERGENCY AND FIXING AN EFFECTIVE DATE. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: The City Council. finds that pursuant to Chapter 22'( ORS and Ordinance No. 70-32 (the City of Tigard Zoning Ordinance of 1970), after public hearing by the City Planning Commission and by the City Council, Ordinance 71-4, amending Ordinance No. 70-32, was duly passed and became effective on the 11th day of January, 1971, whereby there was adopted Chapter 185, supplementary to the zoning ordinance, establishing a Planned Development District, and Section 2: The City Council finds that by Section 5 of said Ordi- nance No. 71-4, there was added to Ordinance No. 70-32, a new section denoted 70-8 - FEES, prescribing fees for various applications for zoning action, and the Council further finds that there was inadvertently omitted therefrom, provision nor"Applications for Planned Development District" as part of the revised fee schedule, and Section 3: The Council further finds that the amendment hereinafter set forth was dilly considered by the Planning Commission and public hearing was held thereon on August 17, 1971, and that the City Council of Tigard held a public hearing with respect thereto on September 13, 1971, and the Council now finds that all legal and proper action has been taken and conditions precedent fulfilled with respect to the amendment to the City Zoning Ordinances as hereinafter set 'forth. Section. 4:-- That Section 270-8 -- FEES - of Ordinance 70-32 (City of Tigard Zoning Ordinance of 1970) adopted by the City Council on August 24, 1970, as amended by Ordinance No. 71-11, as adopted by the Cite Council on the 11th day of January, 1971, be, and the same is, hereby amended and supplemented to read as follows: "SECTION 270-8 - FEES. For the 'purpose of partially defraying the expenses arising from or incident to investigation, evaluation and processing of applications and petitions, and the costs of public notices and hearings incident thereto, the following fees are hereby prescribed and required to be paid to the City at the time of filing of appli- cable petitions and applications, as the case may be: Application for ZONE CHANGE $150.00 Application for PLA14NED RESIDENTIAL (Conditional Use) DEVELOPMENT $250.00 Page 1 ORMINA14CE NO. 71- 3-5- ------------ Ir _ . RE-INSTATEMEIIP OR ENLARGEMENT OF NON•-CONFORMING USE $100.00 Application for VARIANCE $ 50.00 Section 5: Inasmuch as It is necessary for'. the peace, health and safety of the people of the City of Tigard that the zoning matters as hereinabove set forth be established with the least possible delay to thereby currently maintain the legislative and financial integrity of the City Zoning Ordinances, an emergency is hereby declared to exist and this zoning ordinance shall be effective on its enactment by the Council.
