Ordinance No. 71-31 L CITY OF TIGARD, OREGON ORDINANCE No. 71 - 31 AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO THE LANDS OF Wallace E. Johnson in Section s, Township 2 South, Range 1 West, Willamette Meridian, TIGARD. WASHINGTON COUNTY, OREGON. WHEREAS, the hereinafter described lands, by action of the City Council of the City of Tigard, Oregon, pursuant to the Zoning Code of said City, have heretofore been limited in the use to those uses permitted by said Code, under, and have been classified and zoned for, and M-4, Industrial Park; and WHEREAS, pursuant to prescribed procedures, the owner of said lands has applied to the City of Tigard for reclassification of said property and change of zone thereof to permit the use thereof for P.D., Planned Development purposes, and said application has been duly publicized and public hearing held by the City Planning Commission on August 17th, 1971 after due and legal notice; and WHEREAS, the Planning Commission has recommended approval of said zone change to the City Council, and due and legal notice of City Council Hearing hz--sng been given by publication in the Tigard Times, and the City Council having conducted said hearing at its regular meeting of September 13, 1971, and the Council finding that no public detriment will result from granting of said petition, and that it is in the public interest that said zone change, subject to conditions as set forth by the Planning Commission, be approved, and the lands rezoned from M-4, Industrial Park to P.D., Planned Development. NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS- Section 1: That the lands described on the attached sheet headed "DESCRIPTION" be, and the same are, hereby reclassified to permit the use thereof for Planned Deve'opment under the P.D. cka$sification of the Zoning Code of the City of Tigard, subject to the conditions seat forth on the attached sheet entitled "CONDITIONS" which by reference is made a part hereof, to each and all conditions and requirements the development of said lands shall be and remain subtect. Section 2: This ordinance shall be effective on the 31st day after its enactment by the City Council of Tigard, Oregon. PASSED: By unanimous vote of all Council members present, after being read three times by number and title only, this ''ti day of September, 1971.
