ORDINANCE No. 71 - 31
AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO THE LANDS OF
Wallace E. Johnson in Section s, Township 2 South, Range 1 West,
Willamette Meridian, TIGARD. WASHINGTON COUNTY, OREGON.
WHEREAS, the hereinafter described lands, by action of
the City Council of the City of Tigard, Oregon, pursuant to the
Zoning Code of said City, have heretofore been limited in the use
to those uses permitted by said Code, under, and have been
classified and zoned for, and M-4, Industrial Park; and
WHEREAS, pursuant to prescribed procedures, the owner of
said lands has applied to the City of Tigard for reclassification
of said property and change of zone thereof to permit the use
thereof for P.D., Planned Development purposes, and said application
has been duly publicized and public hearing held by the City Planning
Commission on August 17th, 1971 after due and legal notice; and
WHEREAS, the Planning Commission has recommended approval
of said zone change to the City Council, and due and legal notice
of City Council Hearing hz--sng been given by publication in the
Tigard Times, and the City Council having conducted said hearing
at its regular meeting of September 13, 1971, and the Council
finding that no public detriment will result from granting of
said petition, and that it is in the public interest that said zone
change, subject to conditions as set forth by the Planning
Commission, be approved, and the lands rezoned from M-4, Industrial
Park to P.D., Planned Development.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS-
Section 1: That the lands described on the attached sheet
headed "DESCRIPTION" be, and the same are, hereby
reclassified to permit the use thereof for Planned Deve'opment under
the P.D. cka$sification of the Zoning Code of the City of Tigard,
subject to the conditions seat forth on the attached sheet entitled
"CONDITIONS" which by reference is made a part hereof, to each
and all conditions and requirements the development of said lands
shall be and remain subtect.
Section 2: This ordinance shall be effective on the 31st day
after its enactment by the City Council of Tigard, Oregon.
PASSED: By unanimous vote of all Council members present, after
being read three times by number and title only,

"DESCRIPTION"
tj A tract of land . situated in Section 2, Township 2 South,
Range 1 West, of the Willamette Meridian; being Lot 59,
emended: Plat, Forth Tigardville Addition; said Last 59
being more particularly described as follows, to-wit;
Beginning at the northwesterly corner of said. Lot 59,
which northwesterly corner is in the northeasterly right-
of-way line of S.W. Tigard Street. From said place of
beginning; thence South 640 29' East along said north-
easterly right-of-way line, 256.30 Beet to the northeasterly
corner of said hot 59; thence South 330 12' West along the
southeasterly boundary of said Lot 59, which southeasterly
boundary is the centerline of Grant Avenue, 413.00 feet,
more or less, to the centerline of Fanno Creek; thence
westerly following the centerline of Panno Creek to the
intersection of a line which bears South 160 00' West
from said place of beginning; thence North 160 00' East
along the westerly line of said Lot 59, 362.00 feet, more
or less, to the place of beginning. EXCEPTING, herefrom,
those: portions of land dedicated to the public for roadway
purposes.
