WHEREAS, the Boundary Commission established pursuant to
Chapter 494 Oregon Laws of 1559 for the Portland Metropolitan Area,
by its final order datedJul 28 1971 approved the
hereinafter described change in the under as of the City of
Tigard, and a copy of said final order has been filed with the
City Recorder,
NOW THEREFORE,
d; THE CITY OF TIGARD ORDAINS AS FOLLOWS*
Section Is That the final order of the Boundary Cowission
adopted on the 28th_ day of Jul 1871
: a copy whereof is hereto attached and by thea re erenea maw a
part hereof, be, and the same is, hereby ratified, confirmed and
adopted by reference to the aattw legal force and offect as if
set forth herein in full.
Section 2: That the boundaries of the City of Tigard be, and they
are herchy, changed to include the lands as described
in the within order of the Boundary Commission, and the corporate
" limits of the City of Tigard are hereby changed in conformity
therewith:
Section 3i That the Recorder of the City of Tigard be, and she
is hereby, directed to forthwith file a copy of this
ordinance, including at copy of said Order, in the following
i offices:

(c) Department of Records and Elections, Washington County
(d) Department of Public Works, Attentiont Surveyor,

Section 4a That the City Planning Commission be, and it is hereby,
authorized and directed to conduct such proceedings as
may be necessary to conform the authorized zoning and land use of

RE: BOUNDARY CHANGE PROPOSAL NO. 312 M Annexation of the following
territory to the City of Tigard
Legal Description
That portion of hand in the Northeast 1/4 of Section 10,
Township 2 Soath, flange l West, Willamette Meridian, Washington
County, o3-exon, being more particularly described :as follows:
}beginning at a paint which is on the Nor-h line of the
Soatheast quarter of the Northeast quarter of said Section 10
and 5 chains (66.0 feet) West of the East line of said Section
10, and is the Northeast corner of that tract of land conveyed
to John D. Armand cit al, Book 647, Page 163, Med Records Of said
County; ru-nning thence South, along the East line of said Annand
tract, a distance: of 1320 feet to the Southeast corner thereof,
said Soutyte;-ast corner of the Annand tract being a point on the
South line of the Northeast quarter of Section 10; thence East,
slang the South line of said Northeast quarter, a distance: of 330
feet 4o the East quarter rection cornu of Section 10; thence
North, along the East section kine of Section 10, a distance of
32.0 feet to the Nor.thear't corner of the Southeast quarter of the
Northeast quarter of Section 10; thence North, along the East line

3'fIi:RFAS, on Juni. 17, 1971, the Commission received a petition from
property owners requesting that the property described above be
annexed: to the City;
WHEREAS, the petition meets the requirements for initiating boundary
change proposal: in ORS 222.170 and paragraph (a) , Section (1) of
ORS 199.495 ;
WHEREAS, the Commission duly published notice of public hearing in
accordance with ORS 199.520 and conducted a public hearing on
July 28, 1971, in accordance with the rules of the Commission and
paragraph (b), Section. -(1) of ORS 199.475,

WHEREAS,, the Commission caused a study to be made of this proposal
as provided in paragraph (a) , Section (1) of ORS 199.475;
WHEREAS, on the basis of the study which considered economic, demo-
g;aphic, and sociological trends and physical development of the
land, and the public hearing, the Commission found. that: �
a) the territory to be annexed is contiguous to the City;
b) the territory contains approximately 10 acres, one single family
�.... dwelling, a planned unit development under construction and
an estimated population of 3 persons;
c) the property owner requests annexation to obtain City sewer
and building department services ;
d) the City has a sewer main adjacent to the territory and
has the capacity to provide service to existing and future
development in the territory; and
e) the boundary change is a logical extension of the City's
boundary.
WHEREAS, on the basis of the findings the Commission approved
BOUNDARY CHANGE PROPOSAL NO. 312 on July 28, 197:1 ;
NOW THEREFORE IT IS ORDERED THAT the territory described above be
annexed to the City of Tigard as of this date.
