Ordinance No. 70-49 CITY OF TIGARD, OREGON ORDINANCE No.70-2-11— A1N ORDINANCE AMENDING ORDINANCE No.69-25 and ORDINANCE No. 69-33, PRESCRIBING REVISED CONDITIONS FOR CONDITIONAL USE FOR "PLANNED RESIDENTIAL" DEVELOPMENT PURPOSES WITHIN THE R-7 ZONE OF CERTAIN LANDS IN Section 311, TIS, RIW, W.M., TIGARD, WASHINGTON COUNTY, OREGON, DECLARING AN EMERGENCY AND SETTING EFFECTIVE DATE. WHEREAS, by Ordinance No. 69-25, duly passed by the City Council on March 10, 1969, the 'rtnds described therein were rezoned from Washington County SR to R-7 (Single Family Residential); and WHEREAS. by Ordinance No. 69-33, said Ordinance No.69-25 vl;ls amended to authorize "Planned Residential" development on said lands and prescribing conditions applicable thereto; and WHEREAS, application has been made for a change in conditions previously imposed with respect to said Planned Residential develop- ment in order to provide additional flexibility and assure the high- est degree of esthetic, social and economic development; and after dur and legal notice a public hearing was held by the City Planning Commission on November 17, 1970 with respect to said amended condi- tions, and the City Council thereafter duly considered the recommend- ations of the Planning Commission with respect to amendment of con- ditions for the use of said Planned Residential development, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That Section l of Ordinance No.69-33 amending Section 1 of Ordinance No. 69-25, be, and the same is hereby amended to read as follows: "Section 1: That the following described lands be, and the same are hereby reclassified to permit the use thereof for Planned Residential Development under the R-7 (Single- family Residential) classification of the City of Tigard Zoning Ordinance of 1970, subject to the conditions set forth on the attached sheet entitled "CONDITIONS", which by reference is made a part hereof, to each and all of which conditions and requirements the development of said lands shall be and remain_ subject: Beginning at an iron pipe on the westerly line of said Section 34, said pipe being North 0006' West 555.49 feet of the Southwest corner of said Section. 14; running thence North 89952' East 1331.6 feet to a point on centerline of county road No.1992 (5.W.121st Ave.); thence North 0010' WEst 328.07 feet to a point; thence South 89051' West 1321.21 feet to a point on the westerly line of said Sec- tion 34; thence along said section line South 0006' East 327.74 feet to the true print of beginning Section 2: That at the option of the developer of the above de-- scribed lands, the following criteria denoted (a) (b) and (c), or any of them, may be made applicable by the developer to Page 1 - ORDINANCE N0.70- _ f achieve such flexibility as may be desired, and to such degree as the following criteria may be utilized, the foregoing CONDITIONS under Section 1 hereof are modified accordingly: (a) Streets may be naved to a width of no less than 24 feet, with appropriate curbs to provide storm drainage--plans to be approved by City Staff-- provided that parking shall be prohibited on su2h street and that the minimum off-street parking requirements be: 1. A minimum of three (3) off-street spaces for a single-family lot - a total. of 63. 2. A minimum of four M off-street spaces per duplex - a total of 44. 3. A minimum of twenty-five (25) additional off-street spaces shall be provided in parking bays along the street for guest parking. 4. The minimum number of parking spaces shall be 132 for the 43 dwelling units. (b) Normal. front, side and rear setbacks may be waived, provided that each dwelling unit shall have at least one yard of 20 feet or more. (c) That the land may be subdivided in accordance with procedures established by the City's Subdivision Ordinance. Section 3: Inasmuch as it is necessary to preserve the integrity of the zoning regulations of the hereinabove described lands and to enable the developer thereof to pursue thn orderly de- velopment without financial or other hardship induced by delay, it is declared to be in the public interest and necessary for the peace, health and safety of the people of the City of Tigard that this ordi- nance become effective with the least possible delay, and, therefore, an emergency is hereby declared to exist and this ordinance shall be effective upon its passage by the Council and approval by the Mayor. All utilities shall be underground. 2. The total number of dwelling units shall be no r= more than 43 and shall be .residential in character, constructed of materials compatible to surrounding residential developments and no more than two stories in height. 3. That the area designated as open space be dedicated to the City for park purposes with satisfactory guarantee of appropriate grading, seeding and other planting as reviewed and approved by the Planning Department. x, 4. Street tree plantings and decorative lighting shall be required along the street and in parking areas, subject to plan approval by the Planning Department. 5. Flans for the development shall include specifications for storm drainage and utilities, ' x 6. That prior to tree cutting, excavation and building construction, the Planning .Department shall review and apl,.rove individual plot and design plans to insure compatibility of building design, privacy and adequate open space. 7. That final plans showing typical elevations, proposed landscaping, walkways, off-street parking, decorative lighting, park area, storm drainage and utility pro- visions, shall be submitted fro Planning Department approval prior to issuance of building permits. 8.
