Ordinance No. 70-39 CITY OF TIGARD, OREG(In ORDINANCE No-7n- '31-- AN ORDINANCE AUTHORIZING CONVEYANCE OF INTEREST IN LANDS OF THE CITY OF TIGARD TO WASHINGTON COUNTY, OREGON FOR PUBLIC ROAD PURPOSES, DIRECTING THE 14AYOR A14D RECORDER TO EXECUTE A GOOD AND SUFFICIENT DEED THEREFOR, AND DECLARING AN EMERGENCY. THE CITY OF TIG,,RD ORDAINS AS FOLLOWS: Section 1: The Council of the City of Tigard finds that the City of Tigard is the record titleholder of the hereinafter described lands by reason of deed naming the City of Tigard as grantee as recorded in Book 578 at page 345, Washington County Deed Records. Secticn 2: she Council further finds that the following described lands and rights are not required for the public purposes of the City of Tigard. Section 3: The Council further finds that it I,, in the public interest that the following described lands and rights be conveyed to the County of Washington., State of Oregon for public road purposes without compensation therefor pursuant to request for such conveyance by Washington County, Oregon. Section It: The Council of the City of Tigard does hereby direct the City Attorney to prepare a good and sufficient deed of conveyance of the following described lands and rights, naming the City of Tigard as grantor and the County of Washington, State of Oregon as grantee, and the Mayor and Recorder of the City of Tigard be, and they are hereby, authorized and directed to execute such instrument of conveyance as prepared by the City Attorney, to convey the following described lands as herein provided: That nortion of that tract of land conveyed to the City of Tigard, a municipality of the State of Oregon, by deed recorded in Boole 578, page 345, Deed Records of Washington County, Oregon, lying within the fol- lowing described roadway: A roadway 50.0 feet wide, being 25.0 feet on each side of the following descr .bed centerline, to-wit: Beginning at a point in County Road No. 736 (S. W. Bonita Road) in Section 12, T2S, R1W, W.M6 1 which point bears N 890 021 25" E. 174.8 feet and S 0°57° 35" E. 20.2 feet from a 3/4" iron pipe set in County Survey No-3776 for the southeast corner of that tract of land described in Deed Book 160, page 587, Washington County, Oregon Beed Records; thence S 89°02'25" W. 685.0 feet to a poilzt in County Road No. 736 from which point a 5/8" iron rod as set in Survey No. 11, 771 P, said to be set 25.0 feet easterly from the northwest corner of Lot 65, Durham Acres, bears S 0057135" E. 24.9 feet. .4 Section 5: Inasmuch as it is necessary for the peace, health and safety of the people of the City of Tigard that �x Page 1 '- ORDINANCE No. 70- U` 1: r Washington County, Oregon acquire said lands and rights without delay so that necessary road improvements may be constructed, an emergency is hereby declared to evist, and this ordinance shall be effective upon its passage by the Council and approval by the Mayor. g.
