Ordinance No. 70-13 CITY OF TIGARD, OREGON ORDINANCE No. 70- /3 ?,N ORDINANCE: FINDI14G THAT ALL PROCEEDINGS REQUIRED FOR THE WITHDRAWAL FROM COTTONWOOD PLACE LIGHTING DISTRICT_ OF A CERTAIN AREA HERETOFORE ANNEXED TO THE CITY, HAVE BEEN DULY AND Rx'GULARLY CONDUCTED: FURTHER FINDING THAT IT IS IN THE BEST INTERESTS OF THE CITY OF TIGARD TO WITHDRAW SUCH AREA FROM SAID DISTRICT, DESCRIBING THE AREA INVOLVED AND WITHDRAWING SUCH AREA FRC14 THE COTTONWOOD PLACE LIGHTING DISTRICT PURSUANT TO SECTION 222.524 OREGON REVISED STATUTES. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1• The City Council finds that those certain lands described o,, the attached sheet entitled Exhibit "p," - 4-eYc:ription %:-ere duly and regularly annexed to the City of Tigard by Ordinance No. 67--62 enacted by the City Council on October 9, 1967; and Ordinance No. 68-40 enacted on June 10, 1968. Section 2: The Council further finds that all of said lands prior Vsaid annexations and at all times thereafter have been included within Cottonwood Place Lighting District. Stiction 3: The Council further finds that pursuant to Paragraph 222.524 O.R.S. after due and legal notice, a public hearing was duly and regularly held by the Council within the City of Tigard on April 13, 1970, and continued to April 27, 1970, whereat all interested persons were afforded an opportunity to be heard with respect to said withdrawal as.9 said hearing was them- upon duly closed. Section 4: The Cit; Council does hereby find and detar i ne that the withdrawal of said area from Cottonwood Place Lighting District is in the best interests of the City. Section 5: That pursuant to the foregoing and in accordance with. Paragraph 222.524 O.R.S., .all that certain area hereto- fore a part of CW;tonwood Place Lighting Dist"iCt, lying within the boundaries of tw.e City of Tigard as more particularly described in Exhibit "A", be, and the same is hereby, withdrawn from Cottonwood Place Lighting District. Section 6: The Recorder of the City of Tigard be, and she is hereby, authorized and directed to cause to have filers a certified copy of this Ordinance with each of the following department¢ of the C.)unty of Washington, State of Oregon: 1. Department of Revenue and Taxation 2. Department of Records and Elections 1 3.
