ORDINANCE No. 70- ',
AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE
IN THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMMISSION,
ORDER NO. aa, INVOLVING LANDS OF Lamb-Weston IN Section. 1, T2S, RlW,
W.M. WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE, DATE, AND
DECLARING AN EDSERGENCY
WHEREAS, the Boundary Commission established pursuant to
Chanter 494 Oregon Laws of 1969 for the Portland Metropolitan T-rea,

by its final order dated February 11, i9,O, approve
after described change in the boundaries of the City of Tigard, and
a copy of said final order has been filed with the City Recorder,
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS-
Section , :
OLLOWS:Section_1: That the final order of the BoundaryComm.ission�adopted
on the lith day of Feyrua::y, ,0, as
the
City Recorder on the 4th day of March, 1970, a copy whereof is
hereto attached and by this reference made a part hereof, be; and
the same is hereby ratified, confirmed and adopted by reference i.a
the same legal force and effect as if set forth herein_ in full.
Section 2: That the boundarie6 of the City of Tigard be, and they
are hereby, changed to (include) the lands as described
in the within order of the Boundary Corax _ivr:, aid the corporate
limits of the city of Tigard are hereby changed in conformity
therewith.
section 3: That the Recorder of the City of Tigard be, and she is
hereby, directed to forthwith file a copy of this ordi-
nance, including a copy of said Order, in the following offices:
(a) Secretary of State
(b) Department of. Revenue and Taxation, Washington County
(c) Department of Records and Elections, Washington County
(d) Department of Public Works, Attaiition: Surveyor,
Washington County
Section 4: That the City Planning Commission be, and it is hereby,
authorized and directed to conduct such proceedings as
may;be necessary to conform the authorized zoning and land use of
tbF_ described,premises to the requirements of the City's Zoning Map
and Code.
Section 5: Inasmuch as it"is necessary far. the peace: health and
safety of the people of the City of T -zrd }fiat the

RE: BOUNDARY CHANGE PROPOSAL NO. 88 - Annexation of the follow-
ing territory to the City of Tigard
Legal Description
A
`ihat portion of land in Section 1, Township 2 South, Range 1
West, Willamette Meridian, Washington County, Oregon; more
particularly described as follows :
Beginning at the Easterly quarter section corner of said
Section 1, said quarter section corner also being the
initial point of Varnes Acres, a duly recorded subdivision
of record in Washington County, Orego:; thence; running
Westerly along the Northerly line of said subdivision to
a point of intersection with a Southerly extension of the
Easterly right-of-way boundary lute of County Road No. 1601
(S. W. 67th Avenue) , said point of intersection also being
the true point of beginning of this description; thence,
continuing westerly along the said Northerly line! of Varnes
Acres Subdivision to a point of intersection .with a Southerly
extension of the centerlihe of County Read No. 1600 (S. W. -
_ 68th Avenue) ; thence, running Northerly along the said
centerline of S. W. 68th Avenue and extension thereof, to
a point of intersection with the Southerly right-of-way
boundary line of S. W. Hampton Street; thence, running
Easterly along the said Hampton Street boundary line to
a point of intersection with the said Easterly boundary
line of S. W. 67th Avenue; thence, running Southerly along
the said S. W. 67th Avenue right-oaf-gray bou;idary line and
Southerly extension thereof, to the true point of beginning
of this description. Containing approximately 3.2 acres.
WHEREAS, On January 9, 1970 the Commission received a petition from
property owners requesting that the property described above be
annexed to the city;
WHEREAS, the petition meets the requirements for initiating boundary

section (1) , Section 16a of Chapter 494 Oregon Laws 1969;
WHEREAS, the Commission duly published notice of public hearing in
accordance with Chapter 494 Oregon Laws 1969, Section 20 and conducted
r a public hearing on February 11, 1970 in accordance with the rules of
the Commission and Chapter 494 Oregon Laws 1969, Section 13(1) ; and

` WHEREAS, the Commission Caused a study to be made of this proposal
as provided in paragraph (a) , Subsection (1) , section 13 of Chapter
494 Oregon Laws 1969;
WHEREAS, on the basis of the study, which considered economic,
demographic, and sociological. trends and physical development of
the land; and the public hearing, the Commission found that:
a) the territory is contiguous to the citve
b) the territory contains 3.2 acre. and is presently
undeveloped;
c) the territory is adjacent to a rarcel of land which was
recently annexed by the Commission and the property
owners desire to bring this remaining portion of their
property in the city to be developed under city regulations;
and
d) the annexation would not adversely affect any other munici-
pal corporation.
WHEREAS, on the basis of the findings, the Commission approved
BOUNDARY CHANGE PROPOSAL NO. 88 on February 11, 1970;
NOW THEREFORE IT IS ORDERED that the territory described above
be annexed to the City of Tigard as of this date.
