ORDINANCE No-70-3
AN ORDINANCE PROPOSING THE WITHDRAWAL OF ANNEXED AREA WITHIN �
THE CORPORATE LIMITS OF THE CITY OF TIGARD FROM LERON HEIGHTS LIGHTING
DISTRICT; SETTING A DATE, TIME AND PLACE OF HEARING OF OBJECTIONS TO
SUCH WITHDRAWAL; DI"rCTING NOTICE OF HEARING TO BE GIVEN BY PUBLICA-
TION AND POSTING; RESERVING TO COUNCIL DETERMINATION OF RESOLUTION
TO BOUNDARY CC:MMISSION AND DECLARING AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The Council of the City of Tigard finds that those certain
lands described in the attached Exhibit "A" - Description,
by this reference made a part hereof, were regularly annexed to the
City of yiga;rd by Ordinance No.65-21 enacted by the City Council on
July 12, 1965 ; and 68-17,March 25,1968;69-4,January :3,1969;
69-31, Parch 24,1969.
Section 2: The Council fu 'her finds that said lands prior to said
annexation were included within Leron Heights Lighting
District and said lands have not heretofore been withdrawn therefrom.
Section 3: The Council finds that pursuant to §222.524 O.R.S. a pub-
lic hearing should be held to determine the question of
whether withdrawal of said lands from Leron Heights Lighting District
is in the best interests of the City.
Section 4: The Council further finds that if after said hearing it
is determined by the Council that the best interests of
the City require withdrawal of said lands from the Leron Heights
Lighting District, the question of jurisdiction of the Boundary Com-
mission with respect to proposed change in the boundaries of said
Lighting District must be resolved prior to enactment of an ordinance
withdrawing said territory from said District, asprovided in
§222.524(3) O.R.S.
Section 5: Pursuant to the authority conferred upon the City Council
by §§222.520 and 222.524 O.R.S., a public hearing is
hereby called to be held at Fowler Jr. High School
within the City of Tigard on d the 4t1day of March,
1970 beginning at the hour of :00 p.m. Pacific Standard Time of said
day, whereat the City Council will hear objections to the withdrawal
of the lands described in Exhibit "A" from the Leron Heights Lighting
District, and th4Council will thereafter determine whether said with-
drawal is in the best interests of the City of Tigard.
Section 6: The City Recorder of Tigard be, and she is hereby, auth-
orized and directed to give notice of said hearing as
follows:
(a) Publish notice thereof once each week for two successive
weeks, for three publishings in all, prior to the date
of hearing in the Tigard Times, a newspaper of general
circulation within the City.
(b) Post notice of said hearing in not less than four (4)
public and conspicuous places in the City for a like
period of not less than 14 calendar days prior to the
day set for said hearing.

(c) All notices as herein provided shall state the time,
date, place and purpose of said hearing.
Section 7: Inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard ar_d of the
Leron Heights Lighting District that the gt:estion of whether the with-
drawal of territory as herein described be d-termined with the least
possible delay to enable compliance with constitutional and. statutory
budgetary procedur-es, an emergency is hereby declared, and this ordi-
nance shall be effective immediately upcn its passage by the Council
and approval by the Mayor.
PASSED: By unanimous vote of all Council members present after
being read three times by number and title only,
