Section 3: That the Recorder of the City of Tigard be, and she is hereby,directed to forthwith file a copy of nance, including a copy of said Order, in the following offices: (a) Secretary of State Washington County (b) Department of Revenue and Taxation, (c) Department of Records and Elections, Washington County (d) Department of Public Works$ Attention: Surveyor, Washington. Legal Description That portion of Beaverton-Tualatin Highway (State Secondary Highway No. 141) in Section 11 and Section 2, Township 2 South, Range 1 West, Willamette Meridian, Washington County, Oregon; more particularly de- scribed as follows: Beginning at the point of intersection of the centerline of Beaverton- Tualatin Highway with an Easterly extension of "the Northerly right-of- way boundary line of County Road No. 567 (SW O'Mara Street); thence Westerly, along the said boundary line extension, to a point of intersection with the Westerly right-of-way boundary line of said Beavertoa-Tualatin High- way; thence Southerly, along the said Beaverton-Tualatin Highway Westerly boundary line and an extension thereof, to a point of intersection with the Northerly right-of-way boundary line of SW Mountain View Lane (20 feet wide); thence Easterly, along an extension of the said Mountain View Lane boundary line, to a point of intersection with the said centerline of Beaverton-Tualatin Highway; thence Northerly, along the said Beaverton- Tualatin Highway centerline, to the point of beginning of this descrip- tion. WHEREAS, on September 2, 1969, the Commission received a petition from property owners requesting that the property descrived above be annexed to the City; WHEREAS, the petition meets the requirements for initiat:-ng boundary change proposals set forth in ORS 222.170 and paragraph (a), Subsection (1), Section 16 of Chapter. 494 Oregon Laws 1969; WHEREAS, the Commission duly published notice of public hearing in accordance with Chapter 494 Oregon Laws 1969, Section 20 and conducted a public hearing on October 22, 1969 in accordance with the zulas of the Commission and Chapter 494 Oregon Lags 1969; Section 13 (1); and WHEREAS, the Commission caused a study to be made of this proposal as provided in paragraph (a), Subsection (1) Section 13 of Chapter 494 Oregon Laws 1969; WHEREAS, on the basis of the study, which considered economic, demographic, and sociological trends a physical development of the land; and the public hearing, the Commission fouri that a) the territory to be annexed is contiguous to the City; b) the territory to be annexed consists of one-half the right-_f-way, of the Beaverton-Tualatin highway extending from.S.W. O'Mara'Street to S.W. Mountain View Lane; F Page 1 FINAL ORDER NO. 20 /� w 3: c) the annexation is needed in arder to alleviate certain jurisdictional problems of police protection; d) the annexation would eliminate an irregular City boundary; and e) the boundary change would not adversely affect any other unit of local government. WHEREAS, on the basis of the findings the Commission approved BOUNDARY �g CHANGE PROPOSAL NO. 22 on October 22, 1969; NOW THEREFORE IT IS ORDERED that the territory described above be annexed to the City of Tigard as of this date.
