WHEREAS, the boundary Commiasiou establiblied pursuant to Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order dated - approved the herein- the after described change in boundaries of the City of Tigard, and a copy of said final order has been filed with the City Recorder, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the final order of the Boundary Cas issionfiledwith adopted on the 22 _day of natgbZ da of x mh r 19 a copy whereof is City Recorder on the??T Y Eos ' hereto attached and by``tthis reference mads a part hereof, be, and the same is hereby ratified, confirmed and adopted by re fereneP to the same legal force and effect as if set forth herein in full. Section 2. That the boundaries of the City of Tigard be, and they are hereby, changed to �ine� the lands as described in the within order of the Boundary Commission, and the corporate limits of the City of Tigard ave hereby changed in conformity there- with. Section 3: That the Recorder of the City of Tigard be, and she is hereby,directed to forthwith file a copy of this ordi- nance, including a copy of said Order, in the following offices (a) Secretary of State Washington County (b) Department of Revenue and Taxation, (c) Department of Records and Elections, Washington County (d) Department of Public Works, Attention: Surveyor, Washington. County _Section 4 That the City Planning Commis+.on be, and it is hereby, authorized and directed to conduct such proceedings as may be necessary to corsform the authorized zoning and land use of the described premises to the requirements of the City's Zoning Map and Code. Section 5: Inasmuch as it is necessary for the peace, health and safety of the people of the City of Tigard that the foregoing change in the boundaries of the City become a permanent part of the City's records, an emergency is hereby declared to and this ordinance shall be effective upon its passage by x and,approval by the Mayor. Legal Description That portion of the Pacific Highway (State Primary Highway No. 1) situated in the East half of the Northeast quarter of the Southe#st quarter of Section 36, Township 1 South, Range 1 West, Willaiaette Meri- dian, Washington County, Oregon, being more particularly described as follows: Beginning at the point of intersection of the Westerly right-of-way boundary line of Pacific Highway with the Easterly section lune of said Section 36; thence running Southwesterly along the said Highway boundary line 1032 feet, more or less, to an iron pipe at the Southerly-most South- east corner of that tract of land conveyed to Portland General Electric Company as recor: ea in Book 456, Page 433, Deed Records, Washington County, y Oregon; thence South 85° 16' 05" East to a point of intersection with the Easterly right-of-way boundary line of the said Highway; thence North- easterly along the said Highway Easterly boundary line to a point of intersection with the said Easterly section line; thence, Northerly along . the said Easterly section line to the point of beginning of this de- y scription, WHEREAS, on September 2, 1969, the Commission received a petition from pro- perty owners requesting that the property described above be annexed to the City; WHEREAS, the petition.. meets the requirements for initiating boundary change proposals set forth in ORS 222.170 and paragraph (a), Subsection (1), Section y6 of Chapter 494 Oregon Laws 1969; WHEREAS, the Commission duly published notice of public hearing in accordance with Chapter 494 Oregon Laws 1969, Section 20 and coLducted a public hearing r on October 22, 1969 in accordance with the rules of the Commission and Chapter 494, Oregon Laws 1969, Section 13 (1); and ^. WHEREAS, the Commission caused a study to be made of this proposal as pro- vided in paragraph (at, Subsection (1) Section 13 of Chapter 494 Oregon Laws 1969; WHEREAS, on the basis fo the study, which considered economic demographic, and sociological trends and physical development of the land; and the,public hearing, the Commission found that a): the territory to be annexed is contiguous to the city; Page 1 - FINAL ORDER NO. 21 b) the territory to be annexed consists fo a protion of the right-of-way of Pacific Highway (State Primary Highway No. 1) : c) the annexation is needed in order Co alleviate certain jurisdic- tional problems of police protection; d) the annexation would eliminate an irregular City boundary;and e) the boundary change would not adversely affect any other unit of local government. WHEREAS, on the basis of the findings, the Commission approved BOUNDARY CHANGE PROPOSAL NO. 23 on October 22, 1969; NOW THEREFORE IT IS ORDERED that the territory described above be annexed to the City of Tigard as of this date.
