Legal Description That portion of the Pacific Highway (State Primary Highway No. 1) located in Section 12, Township 2 South, Range 1 [Nest, Willamette Meridian, WnaM"Oran County. Oregon: more particularly described as follows: Beginning at the Northeast corner of said Section 12; running thane Westerly along the Northerlj 'Line of said section, to a point of intersection with the Westerly right-of-way line of the Pacific Highway; thence Southerly along the said right-ofakap line 663.0 'f eet, more or less, to the South line of the North half of the Northeast quarter of the Northeast quarter of said Section 12; thence Easterly along the said South line to a point of inter- section with the Easterly Section lin of said Section 12; thence Northerly along the said Easterly Section line, to the point of beginning of this description. WMEREAS, on September 2, 1459, the Commission received a petition from pro- perty owners requesting that the property descrived above be annexed to'the City, WHEREAS, the petition meets the requirements for initiating boundary change proposals set forth in ORS 222.170 and paragraph (a) , Subsection (1), Section 16 of Chapter 494 Oregon Laws 1969; WHEREAS, the Commission duly published notice of public bearing in accordance with Chapter 494 Oregon Laws 1969, Section 20 and conducted a public hearing, on October 22, 1969 in accordance with the rules of the Commission and Chapter 494 Oregon_. Laws 1969, Section 13 (1) and WHEREAS, the Commission caused a study to be made of this proposal as pro- vided in paragraph (a), Subsection (1) Section 13 of Chapter 494 Oregon Laws 1969; WHEREAS, on the basis of the study, which considered economics demographic, and sociological Mends and physical development of the land; and the public hearing, the Commission found that r a) the territory to be annexed is contiguous to the City; s b) the territory to be annexed encompasses approximately 660 feet of the westerly right-of-way of Pacific Highway ;State Primary as Highway No. 1); _ c) the annexation is deeded in order to alleviate certain jurisdic- z tios:al problems of police protection; ` Page 1 - FINAL ORDER NO. 22 � v Y d) the annexation would eliminate an irregular City boundary; and e) the boundary change would not adversely affect any other unit of local government. WHEREAS, on the basis of the findings, the Commission approved BOUNDARY CHANGE PROPOSAL NO. 24 on October 22, 1969; NOW THEREFORE IT IS ORDERED that the territory described above be annexed A to the City of Tigard as of this date.
