AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN THE BOUNDARIES Vl` THE CITY OF TIGARD BY THE BOUNDARY COMMISSION, INVOLVING LANDS OF Oregon State Highway Commission IN Section 12 T2S, RlW WASHINGTON COUNTY, OREGON, RECORDING EFFECT�ZVE DATE A ND- tLARING AN EMERGENCY. WHEREAS, the Boundary Commission established pursuant to Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order dated 1Q�22-f9 approved the herein- after described change in Ye boundaries of the City of Tigard, and a copy of said final order has been filed with the City Recorder, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the final order of the Boundary Commission adopted 19 an the 22 day of Ootober 9.19 6 as filed with the copy whereof is City Recorder on the 11 day of .Tn hereto attached and by�This reference made a part hereof, be, and the same is hereby ratified, confirmed and adopted by reference to the same legal force and effect as if set forth herein in full. Section 2: That the boundaries of the Ci`y of Tigard be, anti they are hereby, changed to (include) the lands as described (axi.twta) in the within order of the Boundary Commission, and the corporate limits of the City of Tigard are hereby changed in conformity there- with. Section 3: That the Recorder of the City of Tigard be, and she is hereby,directed to forthwith file a copy of this ordi- nanee, including a copy of said Order, in the following offices: (a) Secretary of State (b) Department of Revenue and Taxation, Washington County (c) Department of Records and Elections, Washington County (d) Department of Public Works, Attention: Surveyor, Washington County Section 4: That the City Planning Commission be, and it is hereby, authorized and directed to conduct such proceedings as may be necessary to conform the authorized zoning and land use of the described premises to the requirements of the City'a Zoning Map and Code. Recorder - c Z i% L APPROVED: By the Mayor, this dl_day of November , 19.b9..• 'Mayor - City o—gar Page;2 URpINANCE No. Q-8� x h" y PORTLAND METROPOLITAN AREA LOCAL GOVERNMENT BOUNDARY COMMISSION I FINAL ORDER NO. 23 RE: BOUNDARY CHANGE PROPOSAL NO. 25 - Annexation of the following territory to the City of Tigard. j Legal Description k That portion of the Pacific Highway State Primary Highway No. 1 located in Section 12, Township 2 South, Range 1 West, Willamette Meridian, Washington County, Oregon; more particularly described as i follows: Beginning at the point of intersection of the Northerly Line of Lot No. 2 of Bonita Gardens, a subdivision of record in Washington County Deed Records, and the Westerly right-of-way line of the Pacific Highway; running thence Easterly along an extension of the said Northerly line of Lot No. 2, to a point of intersection with the Easterly Section Line of said Section 12; thence Southerly along the said Section Line a distance of 1012.0 feet to a point on the said Section line, said point also being 132.0 feet Southerly ` of an Easterly extension of the Southerly line of Lot No. 1 of said Bonita Gardens; thence Westerly, parallel with the said Easterly E extension of the Southerlyline of Lot No. 1 to a point of inter- ' p [ section with the Pacific highway Westerly right-of-way line; thence Northerly along the said Pacific Highway right-of-way line to the point of beginning of this description. WHEREAS, on September 2, 1969, the Commission received a petition from property owners requesting that the property described above be annexed to the City; WHEREAS, the petition meets the requirements for initiating boundary change proposals set forth in ORS 222.170 and paragraph (a), Subsection (1), Sec- tion 16 of Chapter 494 Oregon Laws 1969; WHEREAS, the. Commission duly published notice of public hearing in accord- k ance wits Chapter 494 Oregon Laws 1969, Section 20 and conducted a public hearing on October 22, 1969 in accordance with the rules of the Conmission and Chapter 494 Oregon Laws 1969, Section 13 (1); and r WHEREAS, the Commission caused a study to be made of this proposal as pro- vided in paragraph (a), Subsection. (l) Section 13 of Chapter 494 Oregon Laws 1969; WHEREAS, on the basis of the study, which considered economic. demographic, and sociological trends and physical development of the land; and the public hearing, the Comission found that _ t Page 1 - FINAL ORDER NO. 23 a) the territory to be annexed is contiguous to the City; b) the territory to be annexed consists of approximately 1000 feet of the westerly half of the Pacific Highway (State Primary Highway f,. No. 1) right-of-way; c) the annexation is needed in order to alleviate certain jurisdic- tional problems of police protection; d) the annexation would eliminate an irregular City boundary; and e) the boundary change would not adversely affect any other unit of local government. WHEREAS, on the basis of the findings, the Commission approved BOUNDARY CHANGE PROPOSAL NO. 25 on October 22, 1969; NOW THEREFORE IT IS ORDERED that the territory described above be annexed : r to the City of Tigard as of this date.
