Ordinance No. 69-79 CITY OF TIGARD, OREGON ORDINANCE No. C AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN i 3 THE; BOUNDARIES OF THE CITY OF TIGARD 13Y THE BOUNDARY COMMISSION, INVOLVING LANDS OF Oregon State highway Commission IN Section 36, TIS, R1W, W.M, WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE ANU DECLARING AN EMERGENCY. WHEREAS, the Boundary Commission established pursuant to Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order dated 10-22-69 aporoved the herein- after described change in the boundaries of the City of Tigard, and a copy of said final order has been filed with the City Recorder, ■ NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the final order of the boundary Co nadoped on the 2aay of QC_tnh d159-4--, as filedwith a copy whereof the City Recorder on thel_ _day ofjjj'L, , Iii' is hereto attached and by this references a part hereof, be, and the same is hereby ratified, confirmed and fadopted hereinrenefull�, to the same legal force and effect as if set Section 2: That the boundaries of the City of Tigard be, and they are hereby, changed to (include) the lands as described (exx3 ) in the within order of the Boundary Commission, and the corporate limits of the City of Tigard are hereby changed in conformity there- With. Section _3: That the Recorder of the City of Tigard be, and she is hereby,directed to forthwith file a copy of this ordi- nance, including a copy of said' Order, in the following offices: (a) Secretary of State (b) Department of Revenue and Taxation, Washington County (c) Department of Records and Elections, Washington County (d) Department of Public Works, Attention: Surveyor, Washington.County Section 4: That the City Planning Commission be, and it is hereby, authorized and directed to conduct such proceedings as may be necessary to conform the authorized zoning and land use of the described premises to the requirements of the City's Zoning Map and Code. Section 5: Inasmuch as it is necessary for the peace, health and safety of the people cf the City of Tigard that the foregoing change in the boundaries of the City become a permanent part of the City's records, an emergency is hereby declared to exist, and this ordinance shall be effective upon its passage by the Council, and approval by the Mayor. Legal Description That portion of the pacific Highway West State Primary No. 1W in Section 36, Township 1 South, Range 1 West, Willamette Meridian, Washington County, Oregon; more particularly described as follows: Beginning at the point of intersection of the northerly extension of S.W. 72nd Avenue centerline with the centerline of Pacific Highway West; thence running Northeasterly along the centerline of Pacific Highway West 1834 feet more or less to a pointonsaid Pacific Highway West centerline; said point being the intersection of the Northerly extension of the Easterly line of that tract of land deeded to Max R. Reed and recorded in Book 611, Page 286 Deed Records Washington County, Oregon, and the said Pacific Highway West centerline. including all portions of the Pacific Highway West right-of-way which lie to the North and to the South of said described Pacific Highway West centerline. T WHEREAT, or, September 2, 1969,the Commission received a petition from pro- perty owners requesting that the property described avove be annexed to the City; WHEREAS, the petition meets the requirements for initiating boundary change proposals set forth in ORS 222.1'0 and paragraph (a), Subsection (1), Section 16 of Chapter 494, Oregon Laws 1969; WH REAS, the Commission duly Published notice of public hearing in accordance >' with Chapter 494 Oregon Laws 1369, Section 20 and conducted a public hearing on October 22, 1969 in accordance with the rules of the Commission and Chapter 494 Oregon Lw4s 1969, Section 13(l); and WHEREAS, the Commission caused a study to be made of this proposal as pro- vided in paragraph (a), Subsection (1) Section 13 of Chapter; 494 Oregon Laws 1969; WHEREAS, on the basis of the study, which considered economic, demographic, and sociological trends and physical development of the land; and the public hearing, the Commission Bund that F Page 1 - FINAL ORDER NO. 24 a) the territory to be annexed is contiguous to the City; b) the territory to be annexed contains 7.2 acres and consists of the pacific Highway (West State Primary No. 1W) right-of-way; c) the annexation is needed in order to alleviate certain jurisdictional problems of police protection; d) the annexation would eliminate an irregular City boundary; and e) the boundary change would not adversely affect any other unit of local government.
