Legal Description That portion of the Beaverton-Tigard Highway State Secondary Highway No. 144 in Section 1, Township 2 South, Range 1 West, Willamette Meridian, Washington County, Oregon; being more particularly described as follows: Beginning at the point of intersection of the South line of the Ceorge Richardson D.L.C. No. 38 with the Northeasterly right- of,-way boundary liae of the Beaverton-Tigard Highway; thence, Westerly along the said claim line, to the Southwest corner of Palzaer Acres, a subdivision of record in Washington County, Oregon; thence, Northerly along the Westerly line of said Palmer Acres sub- division, to the point of intersection with the said Beaverton-- Tigard Highway boundary line; thence, Southeasterly along the said Beaverton-Tigard Highway boundary line, to the point of beginning of this description. WHEREAS, onSeptember2, 1969, the Commission received a petition from property owners requesting that the property described above be annexed to the City; WHEREAS. the petition meets the requirements for initiating boundary change proposals set forth in ORS 222.170 and paragraph (a), Subsection (1) Sec- tion 16 a"of Chapter 494 Oregon Laws 1969; WHEREAS, the Commission duly published notice of public hearing in accord- ance with Chapter 494 Oregon Laws 1969, Section 20 and conducted a public hearing on October 22, 1969 in accordance with the rules of the Commission and Chapter 494 Oregon Laws 1969, Section 13(3); and WHEREAS, the Commission caused a study to be made of this proposal as pro- vided in paragraph (a), Subsection (1) Section 13 of Chapter 494 Oregon Laws 1969; WHEREAS, on the basis of the study, which considered economic, demographic, and sociological trends and physical development of the land; and the public hearing, the Commission found that Page 1 FINAL ORDER NO. 25 ,4 a) the territory to be annexed is contiguous to the city; b) the territory to be annexed consists of a triangular wedge of the Beaverton-Tigard Highway (State Secondary Highway Nc. 144) right \ _ of-way; c) the annexation is needed in order to alleviate certain jurisdic- tional problems of police protection; d) the annexation would eleminate an irregular City boundary; and s { e) the boundary change would not adversely affect any other unit of local government. WHEREAS, on the basis of the findings, the Commission approved BOUNDARY CHANGE PROPOSAL NO. 27 on October 22, 1969; NOW THEREFORE IT IS ORDERED that the territory described above be annexed to the City of Tigard as of this date.
