Legal Description That portion of land in the Northwest quarter of Section 10, Township 2 South, Range 1 West, Willamette Meridian, Washington County, Oregon; being more particularly described as follows: Beginning at a point on the South line of the Amended Flat of Canterbury Place, a subdivision of record in Washington County, Oregon, said point being 145 Leet, more or less, Fast of the Southwest corner of said Canterbury Place, also being the Northwesterly right- of-way of the Pacific Highway West, running thence South 25° 30' 30" East 200.32 feet along said right-of-way to the centerline of S.W. Bull Mountain Road; thence South 78° 17' West along the centerline of said Lull Mountain Road to the Northwesterly corner of that tract of land under contract to Garfield R. Hubble and Ardath E. Hubble and recorded in Book 588, Page 132, Deed Records, Washington County; thence, South 0° 05' East 651.5 feet to the Southwest corner of said Hubble tract; thence, North 89° 27' East along the south line of said Hubble tract and extension there of, across the. Pacific highway West to the Southeasterly right-of-way line of said highway; thence, northeasterly along the said Southeasterly right-of-way line to 1 point of intersection with the south boundary line of that tract of land conveyed to Tigard Evangelical Church, recorded in Kook 738, Page 465, Deed Records, Washington County; thence Easter 'y along the south of said church tract to the Southeast corner; thence, Northerly along the east boundary, to the Northeast corner of said church tract; thence Westerly along the Northerly boundary of said church tract to the intersection with the Southeasterly highway boundary line; thence Northeasterly along said highway boundary line to a point which bears North 0° 20' West 82.5 feet from the South line of said Canterbury Place subdivision; thence, South 89° 40' West across said highway to an iron pin, said iron pin being South 89° 40' West 196.8 feet from the highway as shown in the said amended plat of Canterbury Place; thence South 0° 20' East 82.05 feet to the South line of said Canterbury Place Subdivision; thence Westerly along the said South line of Canterbury Place to the place of beginning. WHEREAS, on September 2, 1969, the Commission received a petition from property owners requesting that the property described above be annexed to the City; WHEREAS, the petition meets the requirements for initiating boundary change proposals set forth in ORS 222.170 and paragraph (a), Subsection (1), Section 16 of Chapter 494 Oregon Laws 1969; WHEREAS, the Commission duly published notice of public hearing in accor- t dance with Chapter 494 Oregon Laws 1969, Section 20 and conducted a public Page 1 -`FINAL ORDER NO. 26 M hearing on October 22, 1969 in accordance with the rules of the Commission and Chapter 494 Oregon Laws 1969, Section 13(l); and WHEREAS, the Commission caused a study to be made of this proposal as pro- vided in paragraph (a), Subsection (1) Section 13 Chapter 494 Oregon Laws 1969; WHEREAS, on the basis of the study, which considered economic, demographic, and sociological trends and physical development of the land; and the public hearing, the Commission found that a) the territory to be annexed is contiguous to the City; b) the territory to be annexed consists of a portion of the right- of-way of Pacific Highway (West State Primary Highway No. 1W) in addition to 5.57 acres westerly and .6 acres easterly of Pacific Highway; c) the property owners need municipal services; d) the city is able to provide needed municipal services, particularly sewer and police protection; and e) the boundary change would not adversely affect any other unit of local government. WHEREAS, on the basis of the findings, the Commission approved BOUNDARY CHANGE PROPOSAL NO. 28 on October 22, 1969; NOW THEREFORE IT IS ORDERED that the territory descrived above be annexed to the City of Tigard as of this date.
