Ordinance No. 69-71 CITY OF TIGARD, OREGON ORDINANCE No. 69 - ! AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMMISSION, INVOLVING LANDS OF CONSTRUCTION COMPONENTS, INC. IN Section 12, T2S, R1W, W.M. WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE AND DECLARING AN EMERGENCY. WHEREAS, the Boundary Commission established pursuant to Chapter 494 Oregon Laws of lSeptemr thT Portland Metropolitan Area, by its final order dated 1969 approved the herein- after described change in�Te boundaries of the City of Tigard, and a copy of said final crder has been filed with the City Recorder, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the final order of the Boundary Commission adopted on the lOday of September , 19 69, as filed with the City Recorder on the 24day of September 1�, a copy whereof is hereto attached and b�his reference made a part hereof, be, and the same is hereby ratified, confirmed and adopted by reference to the name legal, force and effect as if set forth herein in full. Section 2: That the boundaries of the City of Tigard be, and they are hereby, changed to (include) the lands as described in the within order of the Boundary Commission, and the corporate limits of the City of Tigard are hereby changed in conformity there- with. Section 3: That the Recorder of the City of Tigard be, and she is hereby,directed to forthwith file a copy of this ordi- nanco, including a copy of said Order, in the following offices: (a) Secretary of State (b) Department of Revenue and Taxation, Washington County (a) Department of Records and Elections, Washington County (6) Department of Public Works, Attention: Surveyor, Washington County Section 4: That the City Planning Commission be, and it is hereby, authorized and directed to conduct such proceeding's as may be necessary to conform the authorized zoning and land use of the described premises to the requirements of the City's Zoning Map and Code. Section Inasmuch as it is necessary for the peace, health and safety of the people of the City of Tigard that the foregoing change in the boundaries of the City become a permanent. part of the City's records, an emergency is nereby declared to exist, and this ordinance shall be effective upon its passage by the Council, and approval by the Mayor. Legal Description The north 94 feet of the south 194 feet of lot 47, Fanno Creek Tracts, Washington County, Oregon. WHEREAS, on August 15, 1969 the Commission received a petition from proper- tv owners requesting that the property described above be annexed to the City; WHEREAS, the petition meets requirements for initiating boundary change proposals set forth in ORS 222.170 and paragraph (a), subsection (1) Section 16 a of Chapter 494 Oregon Laws 1969; WHEREAS, the Commission scheduled and conducted a public hearing on this proposal as provided in paragraph (b) subsection (1) Section 13 of Chapter 494 Oregon Laws 1969 in Room 680 of the Multnomah County Courthouse on September 10, 1969 at 8:00 p.m.; WHEREAS, the Commission caused notice of the public hearing to be adver- tised in a newspaper of general circulation in the county, posted in the territory to be annexed, and broadcast over radio all as provided in Section 20, Chapter 494 Oregon Laws 1969; WHEREAS, the Commission caused s study to be made of this proposal as provided in paragraph (a), subsection (1) Section 13 of Chapter 494 Oregon Laws 1969; WHEREAS, on the basis of the study the Commission found that: a) the territory to be annexed is contiguous to the city; b) the territory to be annexed contains approximately .82 acnes and a light manufacturing industrial plant is presently being con- structed on the property; c) the property owners need sewer service for the plant; d) the City has sewer facilities in the vicinity of the property and is able to provide the service; and e) the boundary change would not adversely affect any other unit of local government; Page 1FINAL ORDER NO. 14 j t s .
