IN Section 35, T1S, RIW, W.M• WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE AND DECLARING AN EMERGENCY. y_ WHEREAS, the Boundary Commission established pursuant to Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order dated September 10, 1969 approved theherein- afterdescribed change in the boundaries of the Cit of Tigard, a copy of said final order has been filed with the City Recorder, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section_ 1: That the final order of the Boundary Ca� fssioniled w dopted e on the lOt1day of ptember_ , 19 9 , City Recorder on the 24 day of Se tp emth ber , 1f66 . a copy whereof is horeto attached and by�his reference mtade a part hereof, be, and the same is the same le�allreby forceandied effectnasrifdsetdforththereinrinefullE. to Section 2: That the boundaries of the City of Tigard be, and they are hereby, changed to (4l e)the lands as described in the within order of the Boundary Commission, and the corporate limits of the City of Tigard are hereby changed in conformity there- with. Seetion 3: That the Recorder of the City of Tigard be, and she is hereby,directed to forthwith file a copy of this ordi- nance, including a copy of said Order, in the following offices: (a) Secretary of State (b) Department of Revenue and Taxation, Washington County (c) Department of Records and Elections, Washington County (d) Department of Public Works, Attention: Surveyor, Washington County Section 4: That the City Planning• Commission be, and it is hereby, authorized and directed to conduct such proceedings as } may be necessary to conform the authorized zoning and land use of the described premises to the requirements of the City's Zoning Map and Code. Section Inasmuch as it is necessary for the peace, health and safety of the people of the City of Tigard that the foregoing change in the boundaries of the City become a permanent part of the City's records, an emergency is hereby declared to exist, and this ordinance shall be effective upon its passage by the Council, and approval by the Mayor. WHEREAS, on July 16, 1969 the Commission received a petition from property owners requesting that the property described above be annexed to the City; � f } WHEREAS, the petition meets requirements for initiating houndary change proposals set forth in ORS 222.170 and paragraph (a), subsection (1), Section 16a of Chapter 494 Oregon Laws 1969; WHEREAS, the Commission scheduled and conducted a public hearing on this proposal as provided in paragraph (b), subsection (1), Section 13 of Chapter 494 Oregon Laws 1969 in Room 680 of the Multnomah County Courthouse on September 10, 1969 at 8:00 p.m. ; WHEREAS, the Commission caused notice of the public hearing to be advertised in a newspaper of general circulation in the county, posted in the territory to be annexed, and broadcast over radio all as provided in Section 20, Chapter 494 Oregon Laws 1969; WHEREAS, the Commission caused a study to be made of this proposal as provided in paragraph (a), subsection (1), Section 13 of Chapter 494 Oregon Laws 1969; WHEREAS, on the basis of the study the Commission found that: a) the territory to be annexed is cunciguous to the City; b) the territory to be annexed contains approximately .35 acres and a single family dwelling is located on the property; c) the property owner needs sewer service for the single family dwelling; d) the City has sewer facilities in the vicinity of the property and is able to provide the service; e) the boundary change would not adversely affect any other unit of local government. WHEREAS, on the basis of the findings the Commission approved BOUNDARY CHANGE PROPOSAL NO. 12 on September 10, 1969. NOW THEREFORE IT IS ORDERED that the territory described above be annexed to the City of Tigard as of this date.
