Ordinance No. 69-68 1 CITY OF TIGARD, OREGON ORDINANCE No. 69 = ` AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMMISSION, IVvOLVING LANDS OF General Sa:v G.omnany IN Section 12, T2S, R1W, W.M. WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE, AND DECLARING AN EMERGENCY. WHEREAS, the Boundary Commission established pursuant to Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order dated September 10, 1969 approved the herein- after described change in t e boundaries of the City of Tigard, and a copy of said final order has been Piled with t,e City Recorder, NOW, THEREFORE, THE CITY OF TIGAAD ORDAINS AS FOLLOWS: Section is That the final order of the Boundary Commission adopted on the lO day of September_, 19b9 , as filed with the City Recorder on the 24 day of September , 1t9, a copy whereof is hereto attached and by This reference a made a part hereof, be, and the same is hereby ratified, confirmed and adopted by reference to the same legal force and effect as if set forth herein in full. Section 2: That the boundaries of the City of Tigard be, and they are hereby, changed to (include)�e lands as described In the within order of the Boundary Commission, and the corporate limits of the City of Tigard are hereby changed in conformity there- with. Oregon, being more particularly described as follows: Beginning at a point 1320 feet South and 1316.70 feet West of the Nertheast corner of Section 12, said point is also the Northeast corner of the Southwest one--fourth of the Northeast one-fourth of said section 12; thence, South 00 11' West 6.0 Feet to an iron rod at the intersection of the Southerly boundary line of S.W. Bonita Road (County Roadlft. 736) and the Westerly Boundary line of S.W. 72nd Avenue (County Road No. 126); thence, South 890 21' Wpst 454.38 Feet along the Southerly boundary line of S.W. Bonita Road to an iron rod and true point of beginning of the parcel herein described; thence, South 00 39' East 200.0 feet to ar iron rod; thence, South 89° 21' West 190.13 feet to an iron rod on the Easterly right-df-way boundary line of the Southern Pacific Railroad; thence, North 17° 19' West 208.77 feet along the said Railroad boundary line to an ;iron rod; thence, continuing North 170 19' 'gest 20.58 feet to a point of intersection with the centerline of Bonita Road;thence, North 890 21' East 256.0 feet, more or legis, along said Bonita Road centerline to a point; th ance, South 0° 39' East 20.0 feet to the true point of beginning of the parcel herein described. Said parcel containing 1.13 acres WHEREAS, on July 16, 1969 the Commission received a petition from property owners requesting that the property described above be annexed to the City; WHEREAS, the petition meets requirements for initiating boundary change proposals set forth in URS 222.170 and paragraph (a), subsection (1) , Section 16a of Chapter 494 Oregon Laws 1969; WHEREAS, the Commission scheduled and conducted a public hearing on this proposal as provided in paragraph (b), subsection (1), Section 13 of Chapter 494 .Oregon Laws 1969 in Room 680 of the Multnomah County Courthouse on September 10 1969 at 8:00 P.M.; Page one FINAL ORDER NO. 11 J F WHEREAS, the Commission caused notice of the public hearing to be advertised in a newspaper of general circulation in the county, posted in the terri- tory to be annexed, and broadcast over radio all as provided in Section 20, Chapter 494 Oregon Laws 1969; WHEREAS, the Commission caused a study to be made of this proposal as provided in paragraph (a), subsectiosa (1), Section 13 of Chapter 494 Oregoa .Y. Lags 1969; WHEREAS, on the basis of the study the Commission found that: a) the territory to be annexed is contiguous to the City; b) the territory to be annexed contains approximately one acre and is developed as a manufacturing site for light industry; c) the property owner needs sewer service for the manufacturing plant; d) the City has sewer facilities in the vicinity of the property and is able to provide the service; e) the boundary change would not advero4ly affect ;any other 'unit of local government. WHEREAS, on the basis of the findings the Commission approved BOUNDARY CHANGE PROPOSAL NO. 11 on September 10, 1969; NOW THEREFORE IT IS ORDERED that the territory described above be annexed to the City of Tigard as of this date.
