AN ORDINANCE AUTFTGRIZING CONDITIONAL USE ON LANDS OF Hugo Paul and Hareiett Pahl in Section 35, T1S, R1W, W.AL, TIGARD, WASHIYIGTO COC7Nl'Y OREG®N 1+HERF_1kS, the owners of the lands described on attached Exhibit "A" by reference made a part hereof, have filed with the City an application for authorization to conduct the fol- lowing described conditio;:al use on the said premises; and WHEREAS, the zoning classification of said lands here- tofore established by the zoning ordinances of the City of Tigard is C-3 (General Commercial) and the conditional use rey,:ested by the applicants may be properly permitted in con- formity with the said classification; and WHEREAS, the City Planning Commission on the 16th day of July, 1969, held a public hearing with respect to said application and said Commission has recom ended to the City Council that saic application be app and WHh`ItP_AS, a public hearing before the City Council with respect to said application was duly and regularly held on the 11th day of August, 1969, .and the City Council finds that no public detriment will result from the granting of said petition and that it is in the public interest that said con- ditional use be authorized, NOW, THEREFORE, THE CITY OF TIG.ARD ORDAINS AS FOLE,OWS: Section 1: rhat the following conditional use as defined .:-n the City of Tigard Zoning Ordinance under the zone classification: C-3 (General commercial), to-wit: service Station be and the sar.e are hereby authorized with respect to the lands described on Exhibit "A" by reference made a part hereof, subject to compliance with the following conditions: 1. The development be in accordance with the site plan submitted. 2. That only the following signing be permitted: a. one non-moving free-standing business identifi- cation sign be ;sermitted (located as shown on the site plan), the ma;_imum height of this sign to be 35', the minimum height 9' (except for the supporting pole) b. one permanently located price sign matching the architectural design of the main building, a maximum of 12 sq. ft. on each side and a maximum height of 4' 3.. That no par 'spots or intermittently flashing lights be permitted. 4. That no banners, pennants, festoons of light, or other similar suspended devices used for advertising purposes in connection with any sign or commercial enterprise be permitted. 4 � - 5. That at the time of application for a building permit, plans be submitted showing the details of the signs and landscaping, topography and adequate storm drainage. 6. That written approval from the Planning Department shall be obtained prior to any outdoor display or cutdoor merchandising. 7. That this conditional use permit shall expire within one year if the project has not been Ctarted and continual progress toward the completion is not in evidence.
