Section 1: Thss ordinance. shall be .known as the "CITY OF TiuARD UNIFORM :IECfiANiICAL CODE OF 190'9", may be 4ited az such; and will be referred to herein as "this Code". Section 2: The Uniform Building Code, 1967 Edition, Volume II-Part 1, -'- published in 1967 by the International Conference of Building Officials, hereinafter referred to as the "City of Tigard Uniform Mechanical Code of 1969", be, and the same is hereby incor- porated by reference herein to the same legal force and effect as if set forth herein in full, part by part,, chapter by chapter, and sec- tion by section, under authority of 9221.330 O.R.S., which by refer- ence herein is likewise made a part hereof. Section 3: Not less than three (3) copies of said Part I-Volume II- 1967 Edition of The Uniform Building Code - published in 1967 by The International Conference of BuildinC, Officials, shall be maintained on file in the Office of the Cit; Recorder er' the City of Tigard for use and examination by the public , pursuant to 512"!1.3?0 Section 4: That section, 202 of Part I-Volume 1I-1967 Edition. of The Uniform Building Code - published in 1967 by The Inter- national Conference of Building; Officials, with respect to Violations and Penalties, as hereinabove adopted, be, and the same is hereby amended to read as follows: '=Sec. 202. It shall be unlawful for any person, firm, or corporation to erect, install, alter, repair, relocate, add to, replace, use, or maintain heating, ventilating, comfort cooling, or refrigeration equip:nent in the juris- diction, or cause the same to be done; contrary to or in violation of any of the provisions of this Code. Mainte- nance of equipment which was unlawful at the time it was installed and which would be unlawful under this Code if installed after the effective date of this Code, shall constitute a continuing violation of this Code. " page- 1 - ORDINANCE No.69-54 "Any person, firm or corporation violating, any of the provisions of this Code shall be deemed guilty of a miademeat?or, and each such person shall be deemed Suilty of a separate offense for each and every day or portion thereof Burin; Which any violation of any of the pro- visions of this Code is committer_, continued, or per- mitted, and upon, conviction of any such violation such person shall be punishabel by a fine of not more than $300., or by imprisonment .for not more than 90 days, or by both such fine and imprisonment." Section 5: That all ordinances or parts of ordinances which may be inconsistent with the provisions hereof, be, and the same are hereby, repealed effective with the effective date of this ordinance.
