Ordinance No. 69-49 CITY OF TIGARD, OREGON ORDINANCE No, 69- ILL AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF Ann Merrill in Section 36, TIS, R1W, W.M. WASHINGTON COUNTY, OREGON. WHEREAS, the owners of tiic: hereinafter described lands have petitioned the City of Tigard to annex the same to the City, and have filed consent to said annexation with the City Recorder under date of the 25th day of _April_, 1969; and WHEREAS, the lands hereinafter described and proposed to ba annexed are contiguous to the corporate limits of the City of Tigard and are not within the corporate limits of any city and lie wholly within the County of Washington, State of Oregon, and are, in all respects, qualified to be annexed to the City of Tigard; and WHEREAS, By Ordinance No. 69-44 duly enacted by the City Council of Tigard on the 28th day ofAnr i 1 1969, the City Council of Tigard did elect to dispense w -twT-th su mi ing the annexation proposal to the registered voters of the City of Tigard, and did by said ordinance set Monday the 26th day of MAY, , 1969 at the hour of 8:00 p.m. at the Ci y Hall, Tigard, Oregon, as the time and place for public hearing by the Council of said annexation progosali and WHEREAS, said hearing of May '26 1969 was duly publicized by notice published one each week for two successive weeks, ! or three publishings in all, to-wit: On the 8th day ofr 1969, the ].5th day of Ma , INT—and the day et May , , 19 9, Main the Tig rd Times, a newspaper of general circu a on i—published in the City of Tigard, Oregon; that an affidavit of said publication is on file herein and that notice of said hearing was further given by posting in four public and conspicuous places within the City of Tigard for a like period and that the affidavit of the City Recorder with respect to said posting is on file herein; and WHEREAS, the hearing on said proposal was duly and regularly held at the City Hall, City of Tigard, on Ma 26 _ _ , 1969 at the hour of 8:00 p.m., whereat all interested person'-'s and 6gistered voters of the City desiring to be heard, were heard, and said hearing was duly closed; and WHEREAS, it appears that all statutory requirements for the annexation of the following described area to the City of Tigard have received full compliance and that said area may be lawfully annexed to the City of Tigard, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That all of the following described lands be, and the same are, hereby annexed to the City of Tigard, and the boundaries of the City of Tigard be, and they are, hereby extended to include the following described lands within the said boundaries: Page 1 - ORDINANCE No. 69- .114� Property situated in Section 36, Township 1 South, Rance 1 West, of the W.M, in the County of Washington and State of Oregon, more Particularly described as follows; Commencing at an iron pipe located in the NE corner of that certain tract of land conveyed to Joseph Sax by deed recorded in Book 66, page 479, which point is an the N. line of the George Richardson D.L.C. NO- 55; thence S. 0 degrees 17' West a distance of 1108.09 feet, which is the true place of beginning of this description: thence South 88 degrees 58' East a distance of 150 feet; thence South 0 degrees 17' Wast a distance of 100.22 feet; thence uo rth 88 degrees 58' west 150 feet; thence North 0 degrees 17' East 100.72 feet to the true place of beginning, being the southerly 100.12 feet of the 400.72 feet of land 'o purchased by grantors from William P. and Marion J. Rinckhoff, said 100.72 feet adjoining on the north the real property -tow owned by :z Grantees, purchased from said Grantors and said Rinckhoffs. Section 2: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days from the date hereof, to make and submit to the Secretary of State of Oregon: a. A certified copy of this ordinance of annexation b. A certified copy of the statement of consent of the landowners in the territory annexed c. A certified copy of Ordinance No. 69-44 whereby the City r-linni7 declared that no election is required in the City, and to file herein the acknowledgment of the Secretary of State of said filing. Section 3: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days from the date hereof, to file with each of the Department of Revenue and Taxation and the Department of Records and Elections of the County of Washington, the following: a. A certified copy of this ordinance of annexation b. A certified copy of Ordinance No. 69-44 and that a copy of this Ordinance be directed to tTie Office of the Washington County Surveyor, and to file herein the acknowledgments of said Departments of said filings. Section 4: The annexation hereby ordained shall be effective on the date of filing with the Secretary of State of Oregon the copies of proceedings as in Section 2 hereof required to be filed, and from and after said date the hereinabove described and annexed territory shall be and remain a part of the City of Tigard. PASSED: By the Council, by unanimous vote of all Council members present, after being read three times by number and title only, this 26th day of May 1969.
