ORDINANCE No. 69
AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO THE .LANDS OF
Richard 0. Fimmel and Elizabeth Fimmel in Section 12, T2S, R101, W.M.
TIGARD, WASHINGTON COUNTY, OREGON
WHEREAS, the hereinafter described lands, by action of the
City Council of the City of Tigard, Oregon, pursuant to the Zoning
Code of said City, have heretofore been limited in theuse to those uses
permitted by said Code, under, and have been classified and zoned
for, R-7 (Single-family residential) and
WHEREAS, pursuant to prescribed procedures, the owners of
said lands have applied to the City of Tigard for reclassificatior of
said property and change of zone thereof to permit the use thereof
for C-5 (Neighborhood Comm rcial)purposes, and said application has
been duly publicized and public hearing held by the City Planning
Commission on April 15. 1969 after due and legal notice; and
WHRREA3, the Plarning Commission has recommended approval
of said zone change to the City Council, and due and legal notice of
City Council hearing having been given by publication in the Tigard
Times, and the City Council having heard same at its regular meeting
of May 12 1969 , and the Council finding that no public
detr ment w> resuT-from granting of said petition, and that it is ,
in,the public interest that said zone change be approved, and the lands
re-zoned from R_7 (Single-family residential) to C-5 (Neighborhood
Commercial)NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section l: That the following described lands be, and the same are
hereby, zoned as - ,-for use in accordance with the
C-5 (Neighborhood Commercial) ciassificatign of the Zoning Code of
the City of Tigard, which Zoning Code with respect to the
classification is by reference herein made a part hereof:
see attached Descriprion marked "EXIImT A"
Section 2: This ordinance shall be effective on the 31st day after
its enactment by the City Council of Tigard, Oregon.
PASSED: By unanimous vote of all Council members present, after
being read three times by number and title only,

The west one half of the following described tract of land:
Beginning at the Northwest corner of Lot 6, in Wilson Acres
running thence Easterly along the North line of said Lot 6 to
1 the Northeast corner of said Lot 6; thence Southerly along the
East line of said .Lot 6, 320.41 feet, more or less, to a point
in the East line of said lot 6, which point is the Northeast
corner of the tract of land sold to Harry Hambach and wife; thence
Westerly on the North line of said Hambach tract to the Northwest
corner thereof; thence Northerly along the West line of Lot 6 ,
315.88 feet to the point of beginning. EXCEPT therefrom that portion
conveyed to State of Oregon by deed recorded October 1, 1958 in Book
409, page 653, Deed Records of Washington County, Oregon
