Ordinance No. 69-44 CITY OF TIGARD, OREGON ORDINANCE No. 69 AN ORDINANCE SETTING HEARING WITH RESPECT TO PROPOSED ANNEXA- TION OF THE LANDS OF Ann Merrill, in Section 36, T1S, RIW, NI.M. WASHINGTON COUNTY OREGON, AND DIRECTING GIVING W.S � NG OF NOTICE THEREOF.J.._ WHEREAS, there has heretofore been filed with the City Re- corder of the City of Tigard, petition for annexation of certain lands of Ann Merrill IWashington County, Oregon, as hereinafter described; and WHEREAS, said premises are contiguous to the City of Tigard 11 and not within the corporate limits of any other City, and lie wholly within the County of Washington, State of Oregon; and WHEREAS, it appears that said premises may properly be annexed to the City of Tigard without submitting the question to the registered voters of the territory, since the owners thereof, Ann Merrill have by signed petition requested and consented to said annexation; NOW, THEPEFORE, THE CITY OF TIGARD ORDAINS AS FCLLOWS: Section 1: That the City Council of the City of Tigard does hereby elect to dispense with submitting the question of the 9 annexation of the hereinafter described premises to the registered ; voters of the City. Section 2: That Monday, the 26th day of May 1969 at the hour of 8:00 p.m., at the City Hall in the City of Tigard, be, and the same is, hereby fixed as the date, time and place for public hearing before the City. Council of Tigard of the petition of Ann Merrill for annexation of the hereinafter described lands to the City of Tigard, and all registered voters of the City may appear at said time and place and be heard on the question of said annexation. Section 3: The City Recorder of the City of Tigard be, and she is hereby, directed to give notice of said hearing by pub- lication once each week for two successive weeks, or three publish Ings in all, prior to the date of the hearing, in the Tigard Times, a.Dewspaper of general circulation in the City, and said Recorder be, and she is hereby further directed to post notices of said hear- ing in four public places in the City of Tigard for a like period. Section 4: That the area proposed to be annexed be, and the same is hereby described as follows: Page 1 ORDINANCE No. 69 - tr Property situated in Section 36, Township 1 South, Range 1 West, of the W.M. in t:ie County of Washington and State of Oregon, more particularly described as follows: Commencing at an iron pipe located in the NE corner of that certain tract of land conveyed to Joseph Sax by deed recorded in Book 66, page M1979, which point is on the N. line of the George Richardson D.L.C. No. 55; thence S. 0 degrees 17' West a distance of 1108.09 feet, which is the true place of beginning of this description: thence South 88 degrees 58' East a distance of 150 feet; thence South 0 degrees 17' West a 'distance of 100.72 feet; thence North 88 degrees 58' west 150 feet; thence North 0 degrees 17' East 100.72 feet to the true place of beginning, being the southerly 100,72 feet of the 900.72 feet of land purchased by granters from William P. and Marion J. Rinckhoff, said 100.72 feet adjoining on the north the real property now owned by Grantees, purchased from said Grantors and said Rynckhoffs, d } Section 5r Inasmuch as the hearing of the petition for annexation of the lands herein described should be conducted with the least possible delay, an emergency is heereby/declared to exi�sav and it is declared to be necessaryfor the peacehealth and safe_, of the City of Tigard that this ordinance become effective upon its passage by the Council and signature by the Mayor.
