1 AN ORDINANCE AMENDING ORDINANCE No.69-10 (Setting Hearing)
AND ORDINANCE No.69-20 (Annexing property to City of Tigard) TO
CORRECT DESCRIPTION OF THE LANDS OF GLENN L. WILCOX ET UX AND ROBERT
W. REYNOLDS TO CORRECT AN ERROR OF OMISSION IN THE DESCRIPTION OF
THE LANDS TO BE ANNEXED, AND DECLARING AN EMERGENCY.
WHEREAS, on or about January 29, 1969 there was filed with
the City Recorder a certain petition for annexation of 3.53 acres
of land designated therein as "Tax Lots 5200 and 5201, 2S1-12B"
and being more particularly 1eg211y described as "sots 64 and 65,
Durham Acres, Washington County, Oregon"; and
WHEREAS, in processing said application, an error of omission
occurred to that the description contained in Ordinance No.69-10
referring to the lands of G. Wilcox_, L. Wilcox and R. Reynolds as
petitioned to be annexed, omitted Lot 64 Durham Acres; and
WHEREAS, by Ordinance No.69-20 said oI;.ission in said descrip-
tion was perpetuated; and
WHEREAS, the City Council in conducting said hearing and in
approving said annexation did, in fact, intend to annex the said two
tax lots, including 3.53 acres, being all of Lot 64 and Lot 65,
Durham Acres, Washington County, Oregon, and said hearing having been
duly held accordingly, and it is desired hereby to correct the error
of omission in said proceedings,
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS HOLLOWS:
Section l: Thatthe description of the lands set forth in Ordi-
nanee No.69-10 be, and the same is hereby, corrected to
conform to the fact of the lands with respect to which said ordinance
was intended to cover, to read as follows:
"Tax Lots 5200 and 5201, 2S-1-12B, more particu-
larly described as
All of Lot 64 and Lot 65, DURHAM ACRES, a sub-
division of record in Washington County, Oregon"
Section 2: That the description of the lands set forth in Ordi
nar_ce No. 69-20 be, and the same is hereby, corrected to
conform to the fact of the lands with respect to which said ordinance
was intended to,cover, to read as follows:
"Tax Lots 5200 and 5201, 2S-1-12B, more particu-
larly described as:
All of Lot 64 and Lot 65, DURHAM ACRES, a sub-
division of record in Washington County, Oregon."-
k Section 3: That the Recorder of theCity of Tigard be, and she is
hereby directed, within 10 days from the date hereof,
to file a certified copy of this Ordinance with each of the following
Departments r

and to file herein the acknowledgments of said Departments of st
filings.

Section 4: That the City Recorder be, and she is hereby, further
directed to correct the records of the City of Tigard
to conform to the foregoing.
Section5: Inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard that the
foregoing error of omission be corrected with the least possible delay
in order to preserve the integrity of the boundaries of theCity of
Tigard and to avoid further perpetuation of said error, an emergency
is hereby declared to exist, and this ordinance shall be effective
upon its passage by the City Council and approval by the Mayor
PASSED: By the Council, by unanimous vote of all Council members
present, after being read three times by number and
title only, this i4th day of April, 1959. .
