Ordinance No. 69-37 CITY OF TIGARD, OREGON ORDINANCE No. 69-3 AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF Conrad E. Anderson et al, Carl Perry et al in Section 35, T1S, R1W, W.M. WASHINGTON COUNTY, OREGON WHEREAS, the owners of the hereinafter described lands have petitioned the Cizy of Tigard to annex the same to the City, and have filed consent to said annexation with the City Recorder under date of the 27th day of January , 1969; and WHEREAS, the lands hereinafter described and proposed to be annexed are contiguous to the corporate limits of the City of Tigard and are not within the corporate limits of any city and lie wholly within the County of Washington, State of Oregon, and are, in all respects, qualified to be annexed to the City of Tigard; and WHEREAS, Ey Ordinance No. 69-16 duly enacted by the City Council of Tigard on the 10th day of March , 1969, the City Council of Tigard did elect to dispensith submitting the annexation proposal to the registered voters of the Citi of Tigard, and did by said ordinance set Monday the 14th day of April , 1969 tt the hour of 9:00 p.m. at the City Hall, Tigard, Oregon,7sthe time and place for public hearing by the Council of said annexation proposal; and WHEREAS, said hearing of Aril 14 1969 was duly publicized by notice published one eac week for two successive weeke, or three publishings in all, to-wit: On the 27th day of Mach , 1969, the 3rd day of _ April , lYff and the 10th�of April , 1969,- in the Tagard Times, a newspaper of general circulation and published in the City of Tigard, Oregon; that an affidavit of said publication is on file herein and that notice of said hearing was further given by posting in four public and conspicuous places within the City of Tigard for a like period and that the affidavit of the City Recorder with respect to said posting is on file herein; and WHEREAS, the hearing on said proposal was duly and regularly held at the City Hall, City of Tiaard, on A ril 14 , 1969 at the hour of 8:00 p.m., whereat all interaste persons ana registared voters of the City desiring to be heard, :were heard, and said hearing was duly closed; and WHEREAS, it appears that all statutory requirements for the annexation of the following described area to the City of Tigard have received full compliance and that said area may be lawfully annexed to the City of Tigard, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That all of the following described lands be, and the same are, hereby annexed to the City of Tigard, and the boundaries of the City of Tigard be, and they are, hereby extended to include the following described lands within the said boundaries: Page 1 - ORDINANCE No. 64- see attached description marked EXHIBIT "A" j; Section 2: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days from the date hereof, to awake and submit to the Secretary of State of Oregon: a. A certified copy of this ordinance of annexation b. A certified copy of the statement of consent of the landowners in the territory annexed c. A certified copy of Ordinance No. 69-_;L6 whereby the City Council declared that no election is required in the City, and to file herein the acknowledgment of the Secretary of State of said filing. Section 3: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days from the date hereof, to file with each of the Department of Revenue and Taxation and the Department of Records and Elections of the County of Washington, the following: a. A certified copy of this ordinance of annexation b. A certified copy of Ordinance No. 69-16 and that a copy of this Ordinance be directed to ttae Office of the Washington County Surveyor, and to file herein the acknowledgments of said Departments of said filings. Sec Lica40 T.,a a....r .t_cn hereby ;rda4ned ahall be affective on the date of filing with the Secretary of S=ate of Oregon the copies of proceedings as in Section 2 hereof required to be filed, and from and after said date the hereinabove described and annexed { territory shall be and remain a part of the City of Tigard. Anderson, Carl Perry, Gloria Mae Perry, and the State of Oregon, being located in Section 35, Township 1 South, Range 1 West, Willamette Meridian, Washington County, Oregon, and more particularly described as follows: Beginning at the so,ithwest corner of lot 5, Ashbrook Farm, a subdivision of record in Washington County, Oregon, said point of beginning being the northeast corner of that tract of land described in deed to ronrad E. Anderson, et ux, recorded in Book 254, Page 793, Deed Records of said county; running thence south Seo 10' west along the south line of said lots 4 and 5 and an extension thereof 850 feet, more or less, to a point on center line of county road no. 179 (S,W.
