Ordinance No. 69-18 /f CITY OF TIGARD, OREGON ORDINANCE No. 69--i211— AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF Leota J. Miller and Lynn T. Miller, in Sec. 3, T2S, R1W, W.M. WASHINGTON COUNTY, OREGON WHEREAS, the owners of the hereinafter described lands have petitioned the City of Tigard to annex the sa:he to the City, and have filed consent to said annexation with the City Recorder under date of the 27th day of January , 1969; and WHEREAS, the lands hereinafter described and proposed to be annexed are contiguous to the corporate limits of the City of Tigard and are not within the corporate limits of any city and lie wholly within the County of Washington, State of Oregon, and are, in all respects, qualified to be annexed to the City of. Tigard; and WHEREAS, By Ordinance No. 69- 8 duly enacted by the City Council of Tigard on the 10th day of Februar 1969, the City Council of Tigard did elect to dispense wit submitting the annexatiasc proposal to the registered voters of the City of Tigard, and did by �h2 10th day of "arch 1969 said ordinance set Monday � s at the hour of 8:00 p.m. at the City Hall, Tigar , Oregon, as the time and place for public hearing by the Council of said annexation proposal; and WHEREAS, said hearing of March 10. 1969 was duly publicized by notice published one each week for two successive weeks, or three publishings in all, to-wit: On the 20th day of February____# 1959, the 27th day of February 1T6T and the 6t �ay of -March , 1969, in the Tigard Times, a newspaper of general circa atxon an pu Tished in the City of Tigard, Oregon; that an affidavit of sale'. publication is on file herein and that notice of said nearing was further given by posting in four public and conspicuous places within the City of Tigard for a like period and that the affidavit of the City a Recorder with respect to said posting is on file herein; and WHEREAS, the hearing on said proposal was duly and regularly held at the City Hall, City of Tigard, on Marsh 10 1969 at the hour of 8:00 p.m., whereat all interested persons and registered voters of the City desiring to be heard, were heard, and said hearing was duly closed; and WHEREAS, it appears that all statutory requirements for the annexation of the following described area to the City of Tigard have received full compliance and that said area may be lawfully annexed to the City of Tigard, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section l: That all of the following described .lands be, and the same are, hereby annexed to the City of Tigard, and the. boundaries of the City of Tigard be, and they are, hereby extended to include the following described lands within the said boundaries: Page 1 - ORDINANCE No. 69- I The lands of Lynn T. Miller and Leota J. Miller, husband and wife, located in Section 3, Township 2 South, Range 1 West, Willamette Meridian, Washington County, Oregon and more particularly described as follows: Beginning at the S.W. corner of the W. j of the S.W. j of the N.E. i of the S.E. 1 of said section 3; moaning thence north 0° 22' 3911 east 613.83 feet to a point on the south line of county road #1320, (S.W. Park Street); thence south 880 51, 301, east along the south line of said county road 330.46 feet; thence south 0" 17' 49" west 606.64 .feet to the S.E. corner of said W. iia of the S.W. of the N.E. $ of the S.E. j of Section 3; thence south 89° 53' 35" west 331.29 feet to the point of beginning. Excepting the northerly 200 feet of the easterly 154 feet of the above described tract. Section 2: That the Recorder of the City of Tigard be, and she is '-'-`— hereby directed, within 10 days from the date hereof, to make and submit to the Secretary of State of Oregon: a. A certified copy of this ordinance of annexation b. A certified copy of the statement of consent of the landowners in the territory annexed C. A certified copy of Ordinance- No. 69-,.n whereby the City Council declared that no election is required in the City, and to file herein the acknowledgment of the Secretary of State of said filing. Section 3z That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days from the date hereof, to -file with each of the Department of Revenue and Taxation and the Department of Records and Elections of the County of Washington, the following: a. A certified copy of this ordinance of annexation b. A certified copy of Ordinznce No, 69- B and that a copy of this Ordinance be directed to t Office of the Washington County Surveyor, and to file herein the acknowledgments of said Departments of said filings. Section 4: The annexation hereby ordained shall be effective on the date of filing with the Secretary of State of Oregon the copies of proceedings as in Section 2 hereof required to be filed, and from and after said date the hereinabove described and annexed territory shall be and remain a part of the City of Tigard.
