Ordinance No. 69-12 CITY OF TIGARD, OREGON ORDINANCE No. AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF James J. Praggastis, et al and Ted L. Millar, et al, in Section 10, T2S, RlW, W.M. WASHINGTON COUNTY, OREGON WHEREAS, the owners of the hereinafter described lands have petitioned the City of Tigard to annex the same to the City, and have filed Gff s(rnt to said annexation with the City Recorder under date of the day of January , 1969; and WHEREAS, the lands hereinafter described and proposed to be annexed are contiguous to the corporate I.imits of the City of Tigard and are not within the corporate limits of any city and lie wholly within the County of Washington, State of Oregon, and are, in all respects, qualified to be annexed to the City of Tigard; and ivHEREAS, By ordinance No. 69-7 duly enacted by the City Council of Tigard on the _221b day of , 1969, the City Council of Tigard did elect to dispense with su muting the annexation proposal to the registered voters of the City of Tigard, and did by said ordinance set Monday the 24th day of �ree_br�uary __, 1969 at the hour of 8:00 p.m. at thg-City Hall, Tiga' rd, Oregon, as the time and place for public hearing by the Council of said annexation proposal; and WHEREAS, said hearing of Februar 24 '960 was duly publicized by notice published one each week for two successive weeks, or three publishings in all, to-wit: On the 6th day of Fe , 1969, the 13th day of February , 1§0 and the ? ay of February , 19 9,an`tfxe T gard Times, a newspaper of general circu' ation an published in the City of Tigard, Oregon; that an affidavit of said publication is on file herein and that notice of said hearing was further given by posting in four public and conspicuous places within the City of Tigard for a like period and that the affidavit of the City Recorder with respect to said posting is on file herein; and WHEREAS, the hearing on said proposal was duly and regularly held at the City Hall, City of Tigard, on ��;D�ary 24 ` , 1969 at the hour of 8:00 p.m., whereat all interested persons and registered voters of the City desiring to be heard, were heard, and said hearing was duly closed; and WHEREAS, it appears that all statutory requirements for the annexation of the following described area to the City of Tigard have received full compliance and that said area may be ?awfully annexed to the City of Tigard, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section l: That all of the following described lands be, and the same are, hereby annexed to the City of Tigard, and the ( ' boundaries c>f the City of Tigard be, and they are, hereby extended L to include the following described lands within the said boundaries: page 1 - ORDINANCE No. 69- A tract of land in the northeast quarter of Section 10, Township 2 South, Range 1 West, Willamette Meridian, Washington County, Oregon and being the lands of James J. and Kay K. Praggastis, Ted L. and Emily Darlene Millar, and Arthur J. Poulin and Esther L. Poulin, more particularly described as follows: All of that tract of land recorded in contract from Esther A. C. Rock in Book 651, Page 202, Deed records of said county to James J. Praggastis and Kay K. Praggastis, husband and wife, and Ted L. Millar and Emily Darlene Millar, husband and wife, being lot 6 and 6A, amended plat of Canterbsiry Place, a subdivision of record in Washington County, Oregon: excepting that portion deeded to Oregon State Highway Department. Section 2: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days from t..e date hereof, to make and submit to the Secretary of State of Crago_nT a. A certified copy of this ordinance of annexation b. A certified copy of the statement of consent of the landowners is the territory annexed c. A certified copy of ordinance No. 69-7 whereby the City Council declared that no electnaois required in the City, and to file herein the acknowledgment of the Secretary of State of said filing. Section 3: That the Recorder of the City of Tigard be, and she is hereby directed, within 10 days from the date hereof, to file with each of the Department of Revenue and Taxation and the Department of Records and Elections of the County of Washington, the following: a. A certified copy of this ordinance of annexation b. A certified copy of Ordinance No. 69- 7 and that a copy of this ordinance be directed to ItTe office of the Washington County Surveyor, and to file herein the acknow?adgments ' of said Departments of said filings. Section 4: The annexation hereby ordained shall be effective on the date of filing with the fecretaiy of state of Oregon the copies of proceedings as in Section 2 hereof required to be filed, and from and after said date the hereinabove described and annexed territory shall be and remain a part of the City of Tigard. , PASSED: By the Council, by unanimous vote of all Council members present, after being read three tires by number and title only, this 24th day of £'ebruary, 1969.
