ORDINANCE No. G9- .2,
AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF
Henry R. Potter, and jean Audrey Potter in Sec. 34, TIS, R1W, W.M.
WASHINGTON COUNTY, OREGON
WHEREAS, the owners of the hereinafter described lands have
petitioned the City of Tigard to annex the same to the City, and
have filed consent to said annexation with the City Recorder under
date of the 3rd day of December , 1969; and
WHEREAS, the lands hereinafter described and proposed to be
annexed are contiguous to the corporate limits of the City of Tigard
and are not within the corporate limits of any city and lie wholly
within the County of Washington, State of Oregon, and are, in all
respects, qualified to be annexed to the City of Tigard; and
WHEREAS, By Ordinance No. 68-94 duly enacted by the City
Council of Tigard on the 9th day of December 9 , 1968, the City
Council of Tigard did elect to dispense with subms—'t ng the annexation
proposal to the registered voters of the City of Tiqard, and did by
said ordinance set Monday the 13th day of annua, - , 196.
at the hour of 8:00 p.m. at the City Hall, Tsga"—rd; Oregon, as the time
and place for public hearing by the Council of said annexation proposals
and
WHEREAS, said hearing Of Januar 1" 96°OUC'. _ was duly
publicized by notice published one�eac wee or two successive weeks,
or three publishings in all, to-wit: On the 26th day of December ,
I968, the 2nd day of January , 1Yffand the erri ay of
January , 19 9, in the Tigard Times, a newspaper of general
c rcu ation an pu 1.shed in the City of Tigard, Oxegon; that an affidavit
of said publication is on file herein and that notice of said hearing was
further given by posting in four public and conspicuous places within
the City of Tigard for a like period and that the affidavit of the City
Recorder with respect to said posting is on file herein; and
WHEREAS, the hearing on said proposal was duly and regularly
held at the City Hall, City of Tigard, on January 13,_ 1969 at
the hour of 8:00 p.m., whereat all interests persons ani-registered
voters of the City desiring to be heard, were heard, and said hearing
was duly closed; and
WHEREAS, it appears that all statutory requirements for the
annexation of the following described area to the City of Tigard have
received full compliance and that said area may be lawfully annexed
to the City of Tigard,
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS A5 FOLLOWS:
Section_1: That all of the folwing described lands be, and the
same are, hereby an exed to the City of Tigard, and the
boundaries of the City of Tigard be, and they are, hereby extended
.' to include the following described lands within the said boundaries:

The lands of Henry R. Potter and Jean Audrey Potter, husband
and wife, located in Sec. 34, TIS, RiW, W.M., Washington County,
Oregon, more particularly described as follows;
Beginning at an iron pipe on the westerly line of said Section 34,
said pipe being North 00 061 West 655.49 feet of the Southwest corner
of said Section 34; running thence North 890 52' East 1331.6 feet to
a point on centerline of county road number 1192, (S.W. 121st Avenue);
thence North 00 10' West 328.07 feet to a point; thence South 890 51'
West 1321.21 feet to a point on the westerly line of said Section 34;
thence along said section line South 00 06' East 327.74 feet to the
true point of beginning.
Section 2: That the Recorder of the City of Tigard be, and she is
hereby directed. within 10 days from the date hereof,
to make and submit to the Secretary of State of Oregon:
a. A certified copy of this ordinance of annexation
b. A certified copy of the statement of consent of the
landowners in the territory annexed
c. A certified copy of Ordinance No. 68-94 whereby the
City Council declared that no electron is required
in the City,
and to file herein the acknowledgment of the Secretary of State of
said filing.
Section 33: That the Recorder of the City of Tigard be, and she is
herebydirected, within 10 days from the date hereof, to
file with each of the Department of Revenue and Taxation and the
Department of Records and Elections of the County of'Washington,
the following:
a. A certified copy of this ordinance of annexation
b. A certified copy of Ordinance No. 68-94
and that a copy of this Ordinance be directed to tffe- Office of the
Washington County Surveyor, and to file herein the acknowledgments
of said Departments of said filings.
Section 4: The annexation hereby ordained shall be effective on the
.m date of filing with the Secretary of State of Oregon the
copies of,proceedings as in Section 2 hereof required to be filed,
and from and after said date the hereinabove described and annexed
territory shall be and remain a part of the City of Tigard.
PASSED: By the Council, by unanimous vote of all Council members
Present, after being read three times by number and
title only, this 13th day of January , 1969.
