ORDINANCE No. 69 - .2_.
AN ORDINANCE RATIFYING AND CONFIRMING RESOLUTION OF CITY
COUNCIL OF TIGARD OF MAY, 1967, ACCEPTING THE TRANSFER OF S. W.
MAIN STREET AS A CITY STREET FROM WASHINGTON COUNTY, OREGON, AND
DECLARING AN EMERGENCY.
WHEREAS, by resolution of the City Council of Tigard of
April 3, 1967, Washington County was requested to transfer juris-
diction of S. W. Main Street in the City of Tigard to the City;
and
WHEREAS, proceedings were thereafter conducted by Washington
County; and
WHEREAS, at a regular meeting; of the Council of the City of
Tigard on May 8, 1967, it was unanimously resolved by the Council
that the City of Tigard accept jurisdiction of S. W. Main Street
from Washington County, Oregon, and pursuant thereto an agreement
was executed and dated May 9, 1967, between the City and the County
providing for the transfer of said thoroughfare and providing for
the payment by the County to the City in the sum of $6,000.00 to
be applied as part of the public's share of the improvement costs
of Main Street; and
WHEREAS, the County Administrative Officer of the County of
Washington has requested that the City ratify by ordinance the
acceptance of said S. W. Main Street by the City and to thereby
provide by formal legislation a permanent record of the transfer
of S. W. Main Street;
NOW, THEREFORE,
THE CITY. OP TIGARD ORDAINS .AS FOLLOWS:
Section 1: Pursuant to Section 373.270 (5), Oregon Revised Statutes,
all proceedings for the transfer of S. W. Main Street
and the responsibility therefor from Washington County to the City
of Tigard heretofore conducted by the City of Tigard, including
the resolution adopted by the Council at its regular meeting of
May 8, 1967, accepting the transfer of S. W. Main Street, be and
the same are hereby ratified and confirmed, and the City does
hereby again accept and confirm by this ordinance that the juris-
diction of S. W. Main Street from its Southwesterly terminus with
S. W. Pacific Highway to Its Northeasterly terminus with S. W.
Pacific Highway be and the same is hereby declared to be a city
street under the jurisdiction of the City of Tigard in all respects.
Section 2: That a certified copy of this ordinance shall be for
- warded forthwith by the City Recorder to the Board of
Commissioners of Washington County, Oregon, and a copy thereof
placed in the permanent road records of the City of Tigard to
thereby record in perpetuity the jurisdiction of the City of Tigard
with respect to S. W. Main Street.

Section 3: Inasmuch as it is necessary for the peace, health
and safety of the City of Tigard that a permanent
record of the matters hereinabove set forth be establ9,shed among
the ordinances of the City of Tigard without delay, an emergency
is hereby declared to exist, and this ordinance shall become
effective upon its passage by the Council and signature by the
Mayor.
PASSED: By the Council, by unanimous vote of all Council
members present, after being read three times by
