AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF
George J. Burgess & Yvonne Burgess; M. o. McCoy & '.ladys McCoy in
Section 36, TLS, R1W, W.M. WASHINGTON COUNTY, OREGON
WHEREAS, the owners of the hereinafter described lands have
petitioned the City of Tigard to annex the same to the City, and
have filed consent to said annexation with the City Recorder under
date of the 5th day of ,June _, 1968; and
WHEREAS, the lands hereinafter described and proposed to be
annexed are contiguous to the corporate limits of the City of Tigard
and are not within the corporate limits of any city and lie wholly
within the County of Washington, State of Oregon, and are, in all

WHEREAS, By Ordinance No. 687 77 duly enacted by the City
Council of Tigard on the 6th day of � , 1968, the City
Council of Tigard did elect to dispense with su mitting the annexa-
tion proposal to the registered voters of the City of Tigard, and
onday the 9th Say of December 1966
did by said ordinance set M
at the hour of 8:00 p.m. at the City Hamel—, Tigard, Oregon, as the
time and place for public hearing by the Council of said annexation
proposal; and
WHEREAS, said hearing of December 9 1966 was duly
publicized by notice published onom swt

weeks, or three publishings in all, to-wit: On the 2day of
November , 1968, the 28th day of Diovember ,Ur48 and the �_th
Fa 1 , in the `rigar Times, a newspaper of gen—eral
circulat`ionean pub zshed in the City of Tigard, Oregon; that an
affidavit of said publication is on file herein and that notice of
said hearing was further given by posting in four public and conspic-
uous places within the City of Tigard for a like period and that the
affidavitofthe City Recorder with respect to said posting is on
file herein; and
WHEREAS, the hearing on said proposal was duly and regularly
held at the City Hall, City of Tigard, on December nv , 1969
at the hour of 8:00 p.m., whereat all interested Persons and regis-
tered voters of the City desiring to be heard, were heard, and said
hearing was duly closed; and
WHEREAS, it appears that all statutory requirements for the
annexation of the following described area to the City of Tigard have
received full compliance and that said area may be lawfully annexed
to the City of Tigard,
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That all of the following described lands be, and the
same are, hereby annexed to the City of Tigard, and the
boundaries of the City,of Tigard be, and they are, hereby extended
to include the following described lands within the said boundaries:

The lands of George J. Burgess and F. Yvonne Burgess,
Melvin O. McCoy and Gladys M. McCoy being located in Section
36, T1S, R1W, W.M., Washington County, Oregon more particularly
described as follows:
Beginning at an old 1a inch pipe at the Northwest corner of
the East one-half of the Southeast quarter of Section 36, Township
1 South, Range 1 West of the Willamette Meridian, Washington County,
Oregon; thence East 159.2 feet along the Fast and West quarter line
through said Section 36, to a 1/2 inch pine and described as Point A;
thence continuing East 204.81 feet; thence South Oo 20' East 8.00 C
feet to the true place of beginning of the tract herein described;
thence continuing South Oo 20' East along the Westerly line of that
certain tract conveyed by deed recorded April 11, 1951, Book 319,
Page 198, Deed Records, to Paul M. Scheffer, et ux, 322.00 feet to }
a pipe; thence 101.40 feet {gest; thence North Oo 20' West 322.00
feet; thence East 101.40 feet and the true place of beginning.
Section 2: That the Recorder of the City of Tigard be, and she is
hereby directed, within 10 days from the date hereof,
to make and submit to the Secretary of State of Oregon:
a. A certified copy of this ordinance of annexation
b. A certified copy of the statement of consent of
the landowners in the territory annexed
c. A certified copy of Ordinance No. 68- 77 whereby the
City Council declared that no elect
is required
in the City,
and to file herein the acknowledgment of the Secretary of State of F
said filing.
Section 3: That the Recorder of the City of Tigard be, and she is
hereby directed, within 10 days from the date hereof, to
file with each of the Department of Revenue and Taxation and the
Department of Records and Elections of the County of Washington,
the following:
a. A certified copy of this ordinance of annexation
b. A-certified copy of Ordinance No. 68- 77
and that a copy of this Ordinance be directed to the Office of the
Washington County Surveyor, and to file herein the acknowledgments
of said Departments of said filings.
Section 4_: The annexation hereby ordained shall be effective on the
date of filing with the Secretary of State of Oregon the
copies of proceedings as in Section 2 hereof required to be filed,
and from and after said date the hereinabove described and annexed
territory shall be and remain a part of the City of Tigard.
PASSED: By the Council, by unanimous vote of all Council members
present, after being read three times by number and
titles only, this 9th day of Dr!cember 1968.
