AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF I

aWHEREAS, the owners of the hereinafter described lands have
petitioned the City of Tigard to annex the same to the City, and
have filed consent to said. annexation with the City Recorder under
date of the 23 day of September , 1968; and
R} WHEREAS, the lands hereinafter described and pr6posed to be
vt annexed are contiguous to the corporate limits of the City of Tigard
y and are not within the corporate limits of any city and lie wholly
5 within the County of Washington, Stete of Oregon, and are, in all
respects, qualified to be annexed to the City of Tigard; and
WHEREAS, By Ordinance No. 68-73 duly enacted by the City
Council of Tigard on the 14thday of October , 1968, the City
Council of Tigard did elect to dispense with submitting the annexa-
tion proposal to the registered voters of the City of Tigard, and
did by said crdinance set Wed. the 6th day of November 1968
E at the hour of 8:00 p.m. a'_ the City Half, Tigard, Oregon; as the
time and place for public-hearing by the Council of said annexation `
1: proposal; and
WHEREAS, said hearing of November 6, 1968 was duly
publicized by notice published on ch week for two successive
weeks, or three publishings in all, to-wit: On the 17 day of
October , 1968, the 24th day of October =, 68 and the 31
ay o 1967, in the Tigar Times, a newspaper of genu
circulat�.on an published in the City of Tigard, Oregon; that an
r affidavit of said publication is on file herein and that notice of
said hearing was further given by posting in four public and conspic-
uous places within the City of Tigard for a like period and that the
affidavit of the City Recorder with respect to said posting is on
k file herein; and
WHEREAS, tha hearing on said proposal was duly and regularly
J' held at the City Hall, City of Tigard, on November 6 , 1960
at the hour of 8:00 p.m., whereat all intereesteZr persons and regis-
tered voters of the City desiring to be heard, were heard, and said
_ hearing was duly closed; and
WHEREAS, it appears that all statutory requirements for the
annexation of the following described area to the City of Tigard have
received full compliance and that said area may be"lawfully annexed
to the City of Tigard,
NOW, THEREFORE,
THE CITY OF TIGF.P.D ORDAINS AS FOLLOWS:
Section 1: That all of the following described lands be, and the
9. same are, hereby annexed to the City of Tigard, and the
boundaries of the City of Tigard be, and they are, hereby extended
to include the following Iescribed lands within the said boundaries:

The lands of Otto Sorg being a portion of Fanno Creek Acre
Tracts a subdivision of record located in Section 12 Township 2
South, Range 1 West, Willamette Meridian, Washington County, Oregon
more particularly described as follows:
The southerly 54 feet of Lot 48 Fanno Creek Acre Tracts and
the northerly 46 feet of Lot 47 Fanno Creek Acre Tracts and all of
that portion of Cotu;ty Road No. 126, (S.W. 72nd Avenue) lying
3 contiguous and adjacent to the easterly boundary of the above
t tract of land.
Section 2: That the Recorder of the City of Tigard be, and she is
�~ hereby directed, within 10 days from the date hereof,
to make and submit to the Secretary of State of Oregon:
a. A certified copy of this ordinance of annexation
b. A certified copy of the statement of consent of
the landowners in the territory annexed
c. A certified copy of Ordinance No. 68-13 whereby the
City Council declared that no election is required
in the City,
and to file herein the acknowledgment of the Secretary of Sta,ce of
said filing.
Section 3 That the Recorder of the City of Tigard be, and she is
hereby directed, within 10 days from the date hereof, to
file with each of the Department of Revenue and Taxation .and the
Department of Records and Elections of the County of Washington,
the followings
' a. A certified copy of this ordinance of annexation
b. A certified copy of Ordinance No. 68-73
and that a copy of this Ordinance be directed to the Office of the
Washington County Surveyor, and to file herein the acknowledgments
of said Departments of said filings.
Section 4: The annexation hereby ordained shall he effective on the
date of filing with the Secretary of State of Oregon the
copies of proceedings as in Section 2 hereof required to be filed,
and from and after said date the hereinabove described and annexed
territory shall be and remain a part of the City of Tigard.
PASSED: By the Council, by unanimous vote of all Council members
present, after being read three times by number and
title only, this —6th/ day of November 1968.
