Ordinance No. 68-77 CITY OF TIGARD, OREGON ORDINANCE No. 68 - % 2 AN ORDINANCE; SETTING HEARING WITH RESPECT TO PROPOSED ANNEXA- TION OF THE LANDS OF George J. Burgess & Yvonne Burgess; M. O. McCoy s Gladys McCoy in Section 36, T1S, R1W, W.M. WASHINGTON COUNTY, OREGON, AND DIRECTING GIVING OF NOTICE THEREOF. WHEREAS, there has.heretofore been filed with the City Re- corder of the City of Tigard, petition for annexation of certain lands in Section 36, TIS, R1W, W.M. Washington County, Oregon, as hereinafter described; and WHF;REAS, said premises are contiguous to the City of Tigard and not within the corporate limits of any other City, and lie wholly within the County of Washington, State of Oregon; and WHEREAS, it appears that said premises may properly be annexed to the City of Tigard without s omitting the question to the registered voters of the territory, since the owners thereof, George J. Burgess & Yvonne Burgess; M. O, McCoy & Gladys McCoy have by signed petition requested and consented to said annexation; NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the City Council of the pity of Tigard does hereby elect to dispense with submitting the question of the annexation of the hereinafter described premises to the registered voters of the City. Section 2: That Mondays the gth day of December , 1568 at the hour of 8:00 p.m., at the CityH- HaT in-the City of Tigard, be, and the same is, hereby fixed as the date, time and place for public hearing before the City Council of Tigard of the petition of for annexation of the hereinafter described lands to the City of Tigard, and all registered voters of the City may appear at said time and place and be heard on the question of said annexation. Section 3: The City Recorder of the City of Tigard be, and she is hereby, directed to give notice of said hearing by pub- lication once each week for two successive weeks, or three publish- ings 'in all, prior to the date of the hearing, in the Tigard Times, a newspaper of general circulation in the City, and said Recorder be, and she is hereby further directed to post notices of said hear- ing in four public places in the City of Tigard for a like period. Section 4: That the area pr^posed to be annexed be, and the same is hereby described as follows: Page l - ORDINANCE; ;da. 63 The lands of George J. Burgess and F. Yvonne Burgess, Melvin 0. McCoy and Gladys M. McCoy being located in Section 36, T1S, R1W, W.M., Washington County, Oregon more particularly described as follows: Beginning at an old it inch pipe at the Northwest corner of the East one-half of the Southeast quarter of Section 36, Township 1 South, Range 1 West of the Willamette Meridian, Washington County, Oregon= thence East 159.2 feet along the East and West quarter line through said Section 36, to a 1/2 inch pipe and described as Point A; thence continuing East 204.81 feet; thence South 00 20' East 8.00 feet to the true place of beginning of the tract herein described; thence continuing South 00 20' East along the Westerly line of that certain tract conveyed by deed recorded April 11, 1951, Book 319, Page 198, Deed Records, to Paul M. Scheffer, et ux, 322.00 feet to a pipe; thence 101.40 feet West; thence North 00 20` West 322.00 feet; thence Ea---- 101.40 feet and the true place of beginning. Section 5: Inasmuch as the hearing of the petition for annexation of the lands herein described should be conducted with least possible delay, an emergency is hereby declared to exist, the and le is declatad to be necessary for the peace, health and safety it of the City of Tigard that this ordinance became effective upon its passage by the Council and signature by the Mayor.
