Ordinance No. 68-74 CITY OF TIGARD, OREGON ORDINANCE NO. 68%2�1 AN ORDINANCE SETTING HEARING WITH RESPECT TO PETITION PRO- POSING ANNEXATION OF LANDS TO THE CITY OF TIGARD IN SECTION 3, T2S, R1W, WILLAMETTE MIZ2ID-TAN, WASHINGTON COUNTY, OREGON, COMMONLY DESIGNATED THE "115TH AVENUE: ANNEXATION", DIRECTING THE GIVING OF NOTICE, AND DECLARING AN EMERGENCY. WHEREAS, there has heretofore been filed with the City Re- corder of the City of Tigard, petition for annexation of certain lands in Section 3, T2S, RIW, Willamette Meridian, Washington County, Oregon, as hereinafter described; and WHEREAS, said premises are contiguous to the City of Tigard and not within the corporate limits of any other City, and lie wholly within the County of Washington, State of Oregon; and WHEREAS, it appears from said petition that of the ownerships of all tracts included within the total area, more than two-thirds of the land owners owning more than two-thirds of `;,he land repre- senting more than tyro-thirds of the assessed value have Joined in said petition and have thereby consented to the annexation of the respective tracts and the total area to the City of Tigard; NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the City Council of the City of Tigard does hereby elect to dispense with submitting the question of the annexation of the hereinafter described premises to the registered voters of:the City, Section 2: That Monday, the 25th day of November, 1968, at the hour of 8:00 p.m., at the City Hall in the City of Tigard, be, and the same is, hereby fixed as the date, time and place ,for public hearing before the City Council of Tigard of the petition of land owners within the area designated as the "115TH AVENUE ANNEXATION" for-..annexation of the hereinafter described lands to.'Hhe City of Tigard, and all registered voters of the City may appear at said gime and place and be heard on the question of said annexatiana Section 3: The City Recorder of the City of Tigard be, and she is hereby directed to give notice of said hearing by pub- lication once 'cach week for two successive weeks, or three publish- Ings in all, prior tc the date of the hearing, in the Tigard Times, a newspaper of general circulation in the City, and said Recorder be, and she is hereby further directed to post notices of said hearing in four public places in the City of Tigard for a like period. Section b: That the area proposed to be annexed be, and the same is hereby described as follows Page 1 - ORDINANCE No. y, Beginning at the intersection of the East line of S. W. 115th, and the North line of Gaarde Street in the SW 1/4 of the SE 1/4 of Section 3, Township 2 South, Range 1 West, W. M., Washington County, Oregon; thence East along the North line of S. W. Gaarde Street 410 feet to a point on the Westerly line of the tract conveyed to Tigard Assembly of God by deed recorded in Book 622, Page 210; thence North No degrees 37' East along the West line of said church tract 389.66 feet to the Northwest corner thereof; thence North 890 50' East along the North line of said church tract 319 feet to the Northeast corner thereof; thence South along the East line of said church tract 189.66 feet to the Northwest corner of that tract conveyed to Bruce Kenneth Anderson et ux by deed recorded in Book 542, Page 221• thence East along the North line of said Anderson tract 74 feet, more or less, to the Northeast corner thereof; thence North 440 feet along the West line of that tract conveyed to The First Baptist Church of Tigard by deed recorded in Book 463, Page 436 to the Northwest corner thereof; thence East along the North line of said church tract 115.4 feet, more or less, to the Southwest corner of Lot 5, Block 4, Fairhaven Court, a duly recorded subdivision; thence Northerly along the Westerly Boundary of Fairhaven Court to the Northwest corner of Lot 1, Block 3, Fairhaven Court; thence East along the North line of said Lot to the center of S. W. 110th Avenue; thence North 1220 feet, more or less, to the most Northerly corner of Lot 20, B..>rry Dell Plat No. 2, a duly recorded subdivision; thence Northwesterly along the Westerly line of the John L. Hicklin D.L.C. No. 37, 70 feet more or less, to the line dividing the North and South halves of said Section 3; thence Westerly along said dividing line 970 feet, more or less, to the North- east roamer of that tract conveyed to Harry H. Chapman et ux by deed recorded in Book 601, Page 61; thence South along the East line of said Chapman tract 140.0 feet to the Southeast comer thereof; thence North 89° 53' West 296.6 feet to the East line of S. W. 115th, thence South along the East line of S. W. 115th 1180 feet, more or less, to the North line of Virginia Acres; a duly recorded subdivision; thence East along the North line of Virginia Acres anu Virginia Acres No. 2 to the Northeast corner of Lot 19, Virginia Acres No. 2; thence South 000 24' West 447.64 feet to the Southeast corner of Lot 12, Virginia Acres No. 2; thence Westerly along the South line of said subdivisions 498.19 feet to the Southwest corner of Lot 8, Virginia Acres; thence South No degrees 27' West 75 feet; thence South 890 52' West 50 feet; thence North No degrees 27' gest 75 feet to the Southeast corner of Lot 9, Virginia Acres; thence South 89' 54' West 253.0 feet to the East line of S. W. 115th Avenue; thence South along said East line 852036 feet to the true point of beginning. Section 5: Inasmuch as the hearing of the petition for annexation of the lands herein described should be conducted with the least possible delay, an emergency is hereby declared to exist, and it is declared to be necearary for the peace, health and safety Page 2 - ORDINANCE No. 68------ of the City of Tigard that this ordinance become effective upon its passage by the Council and signature by the Mayor.
