Ordinance No. 68-63 PROPOSED AMENDMENT TO CHARTER CITY OF TIGARD, OREGON ' F Ordinance No. 68-63 l AN ORDINANCE AVTHO-MING AND AFFROVING AN AMENDMENT TO THE CHARTER OF THE CITY OF TIGARD OREGON BY ADDING TO CHAPTER IX THEREOF A NEW SECTION NUMBERED 1142", AUTHORIZING THE ISSUANCE-.QF GENERAL.OBLIGATION BONDS OF THE CITY WHEREWITH TO FINANCE THE COST OF STREET IMPROVE- -MPNTS, ACQUISITION OF REAL PROPERTY FOR CITY HALL SITE, ACQUISITION AND DEVELOPMENT OF REAL PROPERTY FOR PARK AND PLAYGROUND PURPOSES, PREPARA'T'ION OF PLANS FOR CONSTRUCTION TO ALLEVIATE DRAINAGE PROBLEMS INCLUDING PLANS FOR STORM DRAINS WITHIN THE CITY, CALLING A SPECIAL ELECTION AT WHICH TFiE PROPOSED CHARTER AMENDMENT SHALL BE SUBMITTED TO THE VOTERS, AND DECLARING AN EMERGENCY. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That there is hereby approved, authorized and adopted an amendment to the Charter of the City of Tigard, by adding thereto a new section numbered 1142" of Chapter IX, reading as follows: "Section 42. The City of Tigard ta, and it is hereby, empowered and authorized to construct, reconstruct, finance, maintain, repair and improve public streets, roads anacquire highways (except state highways) within the City; t real property for a new city hall site; to acquire t prepare develop real property for parks and playgrounds; engineering plans for alleviation of flooding and drainage problems and to prepare engineering plans for storm drains within the City. The City of Tigard and the Council thereof be, and they are, hereby authorized to perform any and all acts necessary and desirable to accomplish and carry out the foregoing and, without limiting the foregoing general auth- ority, the City of Tigard and the Council thereof be, and they are hereby, specifically authorized and empowered, in order to provide funds wherewith to accomplish and carry out the foregoing, to approve, issue and sell general obligation bonds of theCity to mature within twenty (20) years from the date thereof and bearing interest at such rates and with such other terms and conditions as may be approved by the Council of the City of Tigard, in a total sum not to exceed $750,000. f2The City of Tigard be, and it is hereby, authorized without limitation, and subvect only to outstanding bonds for which previous pledges existto pledge the general credit and taxing power of the City for the repayment of such bond issue. "Any and all matters that may require the action or of the City Council in connection with the activities ( hereby authorized, shall be approved either by ordinance or h by resolution of the City Council." Section 2: A special election is hereby fixed and called to be held on she 23rd day of September, 1968 between the hours of $t00 a.m.Yand 13:00 p.m., Pacific Daylight Time, in theCouncilRoom of the Tigard City Hall, for the purpose of submitting to the legal Page 1 - Ordinance No. 68-63 voters the question of approval or rejection of the foregoing charter amendment, and said election on said question shall be held in accord- ance with the provisions of the Charter of the City of Tigard and the applicable election laws of the State of Oregon. Section 3: The City Recorder be, and she is hereby authorized and directed to cause to have published in the Tigard Times, a newspaper published and of general circulation in the City of Tigard, Oregon, notice of said election in the issues thereof on September 5, 12 and 19,1968, and shall further post notices thereof in three public places in the City of Tigard, Oregon. Section 4: The following persons are hereby designated to serve as Clerks of said election, who shall take an oath to support the Constitution of the State of Oregon and of the United States, and to faithfully perform the duties of said offices: Dixie Klock, Chair- man, Beulah Butterfield, Virginia Hanes, Lena Nunnenkamp, Viola Larson and Jean Sauder. Section 5: The official ballot title for the foregoing measure as it shall appear upon the official ballot used at the special election to be held on September 23, 1968, is hereby provised, auth- orized and approved as follows: City of Tigard, Oregon Charter Amendment Submitted to the Voters by the City Council: Vote YES or NO Purpose: An amendment to the Charter of the City of Tigard, adding a new section nranbered 1142" of Chapter IX, authorizing the issuance of general obligation bonds of the City for the purpose of construe ting, reconstructing, financing, maintaining, repairing and 3m- proving public streets_ roads and highways YES 51. (except state highways? within the City; acquiring real property for a new city hall site; acquiring and developing real property for parks and playgrounds; preparing engin- El eering plans for alleviation of flooding and NO drainage problems and preparing engineering plans for storm drains within the City; in a sum not to exceed $750,000., and pledging the City's general credit and taxing power, sub= ject to outstanding bonds for which previous pledges exist, for the repayment of said bonds Including principal and interest thereof. Section 6: Inasmuch as there is urgent need for street road and highway improvements(except state highways; within the City of Tigard, and urgent need for acquisition of lands for city hall site and for park and playground purposes, and it is immediately necessary to prepare plans to overcome drainage problems within the City and to provide plans for storm drains, and it is necessary for the peace, health and safety of the City that .this amendment to the . City Charter be submitted to the voters without delay, an emergency is hereby declared to exist, and this ordinance shall take effect immediately upon its passage by the Council and approval bytheMayor.
