ORDINANCE No. 68-53
AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO THE LANDS
OF Jules E. Kessler and Gilbert E. and Grace Pierce in Section 12,
T2S RlW W.M. TIGARD WASHINGTON COUNTY OREGON
WHEREAS, the hereinafter described lands, by action of the
City Council of the City of Tigard, Oregon, pursuant to the Zoning
Code of said City, have heretofore been limited in use to those uses
permitted by said Code, under, and have been classified and zoned
for, R-7 (Residential); and
WHEREAS, pursuant to prescribed procedures, the owners of said
lands have applied to the City of Tigard for reclassification of said
property and change of zone thereof to permit the use thereof for
A-2 (Multiple Dwelling) purposes, and said application has been duly
publicized and public hearing held by the City Planning Commission
on July 16 1968 after due and legal notice; and
WHEREAS, the Planning Commission has recommended approval of
said zone change to the City Council, and due and legal notice of
City Council hearing having bean given by publication in the Tigard
Times, and the City Council having heard same at its regular meeting
of July 22, 1968, and the Council finds that said lands are well-
adapted to and meet the criteria required for multiple dwelling use
ONLY if all occupancy units constructed on the premises are connected
to the City sewer system, and that it is in the public interest that
said zone change be approved CONDITIONED upon the requirement of
connection to the City sewer system;NOW, THEREFORE,
THE CITY OF TIUARD ORDAINS AS FOLLOWS:
Section 1: That the following described lands be, and the same are,
hereby zoned as A-2 for use in accordance with the A-2
_ (Multiple Dwelling) classification of the Zoning Code of the City of
Tigard, which Zoning Code With respect to the A-2 classification is
by reference herein made a part hereof, CONDITIONED that no building
permit shall be issued with respect there o un ess and until pro-
vision has been made for the oennecti.on of any residential structures
thereon to the City sewer syctem in accordance with the statutes of
the State of Oregon and the ordinances of the City of Tigard:
Lots 63 and 66 Durham Acres excepting the North
170 .feet of the West 205 feet of Lot 66.
Section 2: This ordinance shall be effective on the 31st day after
its enactment by the City Council of Tigard, Oregon.
PASSED: By unanimous vote of all Council members present, after
being read three times by number and title only, this
